army CONTRACTING AGENCY CICA Automatic stay Override Guide April 2004 1 FOREWORD The Competition in CONTRACTING Act (CICA) requires the CONTRACTING Officer to withhold award of a contract or, if the contract has already been awarded, to suspend contract performance when a protest is properly filed to the AGENCY under FAR or to the General Accounting Office (GAO) under FAR This is known as the CICA Automatic stay requirement. CICA permits the AGENCY to override the Automatic stay if certain conditions are met. These requirements are generally laid out in FAR (f) for AGENCY protests and FAR (a) and (c) for protests files with the GAO. It is imperative that any decision to override the Automatic stay requirement be carefully prepared and documented to withstand judicial scrutiny. An interested party to the protest may challenge the override decision in either the Court of the Federal Claims or the United States District Court.
