BAKERY ANDCONFECTIONERYUNION ANDINDUSTRYINTERNATIONALPENSIONFUNDA greement and Declarationof TrustDATEDSEPTEMBER 11,1955 INCLUDING ALL AMENDMENTSADOPTED THROUGHJUNE 30, 2009 AGREEMENT AND DECLARATION OF TRUSTE stablishing theBakery and CONFECTIONERY UNION and IndustryInternational Pension Fund(WITH AMENDMENTS TO JUNE 30, 2009)THIS AGREEMENT AND DECLARATION OF TRUST is made and entered into as of the 11th day of September, 1955, in theCity of New York, State of New York, by and between the BAKERY , CONFECTIONERY , Tobacco Workers and Grain Millers InternationalUnion (hereinafter referred to as the International UNION ), and various employers in the BAKERY and CONFECTIONERY Industries whoare or who may become parties to this agreement as hereinafter defined (hereinafter referred to as Employers ).

Section 3. ACCEPTANCE OF TRUSTEESHIP. The Trustees shall immediately meet and sign this Agreement and Declaration of Trust which establishes the Pension Fund.
