Effective January 1, 2020, section 621(b) of the Unemployment Insurance Code (CUIC)California (leginfo. ) was amended to apply a new standard for classifying workers as independent contractors rather than employees for purposes of the CUIC. Under the new standard (commonly referred to as the ABC test ), an individual providing labor or services for remuneration is presumed to be an employee rather than an independent contractor, unless the hiring entity can demonstrate that three conditions are satisfed (see Step 3 below). The ABC test has replaced the standard set forth in S. G. Borello & Sons, Inc. v. Department of Industrial Relations (1989) 48 341 (Borello).
CONSTRUCTION INDUSTRY Under California law, a contractor, licensed or unlicensed, who engages the services of unlicensed subcontractors or construction workers is, by specific statute, the employer of those unlicensed subcontractors or workers, even if the subcontractors or workers are independent contractors under the usual common law rules.
