Effective January 1, 2020, section 621(b) of the Unemployment Insurance Code (CUIC)California (leginfo. ) was amended to apply a new standard for classifying workers as independent contractors rather than employees for purposes of the CUIC. Under the new standard (commonly referred to as the ABC test ), an individual providing labor or services for remuneration is presumed to be an employee rather than an independent contractor, unless the hiring entity can demonstrate that three conditions are satisfed (see Step 3 below).
(b) When subdivision (a) does not apply, ‘employee’ shall also mean any individual who is an employee, pursuant to Section 2750.5 of the Labor Code, of a person who is required to obtain a valid state contractor’s license pursuant to Chapter 9 (commencing with Section 7000) of Division 3 of the Business and Professions Code.”
