When there is uncertainty as to the legal obligations or rights associated with a potential future course of action , declaratoryrelief offers an immediate means to resolve this uncertainty. Both federal and Georgia law provide for mechanisms by which litigantsmay seek declaratoryrelief from the courts. Specifically, the Federal Declaratory Judgment Act states:In a case of actual controversy within its jurisdiction, .. any court ofthe United States, upon the filing of an appropriate pleading, may declare the rights and other legal relations of any interested partyseeking such declaration, whether or not further relief is or could be sought.
