Critical access Hospital fact sHeet1 FACTSHEETC ritical access Hospital Le g i s l a t i o n e n a c t e d a s p a r t o f t h e Ba l a n c e d Bu d g e t ac t (BBa) o f 1997 authorized states to establish State Medicare Rural Hospital Flexibility Programs (Flex Program), under which certain facilities participating in Medicare can become Critical access Hospitals (CAH). The following providers may be eligible to become CAHs: n Currently participating Medicare hospitals; n Hospitals that ceased operation during the 10 year period from November 29, 1989 through November 29, 1999; or n Health clinics or centers (as defined by the State) that previously operated as a Hospital before being downsized to a health clinic or center. Unlike facilities such as Medicare Dependent Hospitals or Sole Community Hospitals, CAHs represent a separate provider type with their own Medicare Conditions of Participation as well as a separate payment access Hospital Designation A Hospital must meet the following criteria to be designated a CAH: n Be located in a state that has established a State Flex Program (as of December 2008, only Connecticut, Delaware, Maryland, New Jersey, and Rhode Island did not have such a program); n Be located in a rural area or be treated as rural under a special provision that al
