LIMITATION AND CONSUMER FINANCIAL services complaints by Adam Samuel I: INTRODUCTION The last decade has been a tumultuous one for LIMITATION and CONSUMER complaints . At the start of 2001, nobody gave the subject any great thought although perhaps they should have. The Court of Appeal s decision in Cave v. Robinson, Jarvis & Rolf and the Brocklebury case before it applied section 32 of the LIMITATION Act to a fairly standard professional negligence case. All that was necessary for this was that the act complained of was deliberate and that its nature was such that it could not be easily discovered by the victim. Where section 32 applies, time runs from 6 years from the victim s discovery or when he should have discovered that he had a cause of action. The 15 year backstop which normally time-bars claims made 15 years after the relevant event does not apply when section 32 does.
