INTRODUCTION One of the MAGISTRATE s most important functions is that of a judicial officer in conducting a probable cause hearing for ARREST . This chapter is designed to enable the MAGISTRATE to conduct a proper probable cause hearing by discussing the basic elements of criminal law and defining probable cause. Additionally, most of the specific statutes regarding ARREST procedures will be discussed. How to issue an ARREST warrant or summons will be discussed as well as certain limitations imposed on the Virginia MAGISTRATE . While this chapter provides some information concerning proper ARREST procedures , the legality of an ARREST generally is not an issue affecting the outcome of a probable cause hearing before a MAGISTRATE .
