1 Trimble Navigation Limited General Terms and Conditions Regarding Trimble Equipment, Software and Services Last updated February 2009 IMPORTANT. PLEASE READ THIS CAREFULLY. These General Terms and Conditions, together with the applicable product schedule(s), create a legally binding agreement ( Agreement ) between you/your organization ( you or Customer ) and Trimble Navigation Limited ( Trimble ). This Agreement sets forth the terms and conditions for use of: ( Equipment ) shall mean those items of hardware or equipment specified on an applicable Product Schedule to be purchased by Customer and sold by Trimble . ( Software ) shall mean Trimble software. ( Service ) shall mean the specific Trimble service offerings specified on an applicable Product Schedule to be provided by Trimble to Customer under this Agreement, along with certain enhancements thereto, to the extent specified on such Product Schedule ( Product Schedule ) shall be that document submitted by Customer, by which Customer offers to purchase Equipment and/or Service from
