The impetus for the project arose from the lack of a definition of UNDUE influence in the california Probate Code. The term itself appears in the Probate Code where the execution of wills is concerned ( california Probate Code 6104 (2010)), when a gift is in question ( california Probate Code 21350 (2010)), and in other sections concerned with will contests and prohibited transferees.

This group of people has now reached the age of 60 and is growing faster than the general population. For instance, the elderly population in California was 12 percent of the state in 1990 but will grow to 14 percent by 2020. During the same time period, the group of people over age 60 will increase by 112 percent.
