1 McKenzie Banking Company/Foundation BankInternet Banking Agreement-CommercialThis Agreement is entered into between McKenzie Banking Company/Foundation bank (the bank ) and any customer of the bank who subscribes to McKenzie BankingCompany/Foundation bank s Internet Banking . The customer is referred to in this agreement as "you" or "your". The bank is referred to in this Agreement as " bank ", "us",and/or "our". This Agreement may be modified from time to time as hereinafter set forth by the bank . If you use Internet Banking or permit another to use Internet Banking onyour behalf, you agree to the terms and conditions stated in this Agreement. You must follow all of our instructions and procedures applicable to the services covered by ACCOUNTS, AGREEMENTS AND SERVICEST hese terms and conditions are in addition to those that apply to any account(s) you may have with us at the time of this Agreement (whether or not listed on this Agreement) orany other services or accounts you obtain from us in the future.
2 This includes your signature card, the account and deposit disclosures, agreements, fee schedules, terms andconditions of any loan or credit agreements, the accompanying schedules, disclosures, and any change of term(s) notices. This Agreement supersedes any prior InternetCustomer Agreement entered into by bank and fund transfer ACT AND REGULATION EThe electronic Funds transfer Act (EFTA) and its implementing regulation, Regulation E ( REG E ), govern some of the transactions permitted through Internet Banking . Someof the terms and conditions of this Agreement are disclosures required by REG REQUIREMENTSIn order to use Internet Banking , you will need the type of computer, related equipment, and software described in the Instructions. (In this Agreement, your computer and the related equipment are referred to as your computer".) You are responsible for the installation, maintenance, and operation of your computer and your software.
3 The risk of error,failure, or nonperformance is your risk. The bank is not responsible for any errors or failures from any malfunction of your computer or your software. The bank is not responsible for any computer virus related problems that may be associated with the use of the Internet Banking system. The bank shall have no liability to you for any damage or other loss, direct or consequential, which you may suffer or incur by reason of your use of your computer or your software. THE bank MAKES NO WARRANTY TO YOU REGARDING YOUR COMPUTER OR YOUR SOFTWARE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR bank 's Internet Banking service is offered through an automated Commercial Enrollment option located on the bank 's webpage. The customer must complete all fields ofthe enrollment form. The customer will set up their User ID and Password in the initial enrollment process.
4 If the information entered into the enrollment form fields match theBank's Core System, customer will automatically be enrolled for the service and receive an email from McKenzie Banking company notifying the customer they may login intoInternet Banking using the User ID and Password set up in the enrollment process. If the fields do not match the bank 's Core System, a representative of the bank will call thecustomer to confirm the information entered, correct the information in the Core System and resubmit the enrollment form for processing. Joint account holders are encouragedto obtain their own Internet Banking access and enroll separately. Customer's enrolling in Internet Banking may or may not be a primary or secondary on the exact sameaccounts. Therefore, exclusive confidentiality of the individual User ID and Password is vital to the confidentiality of customer's accounts.
5 Sole use and sole confidentiality ofthe User ID and Password is the agreed security procedure between you and the bank . It is customer's responsibility to keep their User ID and Password confidential in order toprevent unauthorized use and possible loss to your accounts and to prevent unauthorized use of Internet Banking . ANYONE to whom you give or disclose your User ID andPassword will have full access to your account(s), even if you attempt to limit that person's you forget your Password you may contact the bank to have a new temporary Password issued or customer may utilize the Forgot Your Password feature within the loginprocess. For your protection, if you request a new Password or to reset your Password, the bank will take any and all precautionary measures that it deems necessary topositively identify you. Such precautionary measures may also include the requirement for you to personally come to the bank for the new Password.
6 Unless the customerinitiates the call to the bank and customer has been positively identified, under no circumstances should a bank employee request your Password for Internet Banking . Do notrespond to any such request, even if the person claims to represent the Notice: Only if separate Passwords are assigned to each Internet Banking User, can such user(s) only have access to accounts in which they are a primary or asecondary account holder now or anytime in the bank is committed to the security of its customers' accounts and account information. Similarly, you must take every precaution to ensure the safety, security and integrity ofyour accounts and transactions with Internet Banking . The User ID and Password to your accounts and other services provided herein; your providing the User ID and Passwordto another person effectively constitutes a grant of authority to access your accounts under REG E.

Internet Banking FUNCTIONSYou may use Internet Banking to gain access to deposit accounts in which you have the unrestricted right to withdraw funds. However, the bank , may determine at any time todeny Internet Banking account access, restrict Internet Banking account transactions, or place limits on the specific dollar amount of funds that may be withdrawn or transferredfrom any you subscribe to this service, you may use Internet Banking to:> transfer funds between your deposit accounts> Make loan payments > Obtain account balances and transaction information for your deposit and loan accounts> Review history transactions > Send and receive electronic mail (secure e-mail to the bank )*ONLY EMAIL SENT OR RECEIVED THROUGH OUR Internet Banking SYSTEM WILL BE CONSIDERED SECURE. 10 You can perform no more than six (6) transfers from amoney market account during each cycle/month, and no more than three (3) of such transfers may be made by check.
