7 It refines policy andp r o c e d u r e s f o r p e r s o n n e l i n a n a b s e n twithout leave status who are charged withor convicted of a civilian or criminal of-fense or confined or restricted by a courtorder. This regulation provides proceduresfor verifying the military status of person-nel whose military records are h i s r e g u l a t i o n p r o v i d e s p r o c e d u r e s f o rverifying whether Army National Guardand United States Army Reserve Soldierswho fail to report for mobilization knewof or received their mobilization orders.

8 Itimplements Department of Defense Direc-tive This regulation changes theprocedures for Army National Guard andU n i t e d S t a t e s A r m y R e s e r v e m e m b e r swho fail to report for initial active dutyfor This regulation applies tot h e A c t i v e A r m y , t h e A r m y N a t i o n a lG u a r d o f t h e U n i t e d S t a t e s , a n d t h eUnited States Army Reserve unless other-wise and exception proponent of this regulation is TheProvost Marshal General. The proponenthas the authority to approve exceptions orwaivers to this regulation that are consis-tent with controlling law and proponent may delegate this approvalauthority, in writing, to a division chiefwithin the proponent agency or a directreporting unit or field operating agency ofthe proponent agency in the grade of colo-nel or the civilian equivalent.

9 Activitiesmay request a waiver to this regulation byproviding justification that includes a fullanalysis of the expected benefits and musti n c l u d e f o r m a l r e v i e w b y t h e a c t i v i t y ssenior legal officer. All waiver requestswill be endorsed by the commander ors e n i o r l e a d e r o f t h e r e q u e s t i n g a c t i v i t yand forwarded through their higher head-quarters to the policy proponent. Refer toAR 25 30 for specific management control regulation contains management con-trol provisions and identifies key manage-ment controls that must be u p p l e m e n t a t i o n.
