3 Theothershallnotbeobligated,tobargaincol lectivelywithrespecttoanysubjectormatter whetherornotreferredtoorcoveredinthisAgr eement, ,color,religiouscreed,sex,age,nationalor igin,ancestry,maritalstatus,mentalretard ationorphysicaldisabilityinciuding,butno tlimitedto, ,ifany,whetherintentionalorunintentional ,toeliminatepresentdiscrimination,ifany, ,ripeoranticipated, ,eitherdirectlyorindirectly, ,(ADA).AttherequestoftheUnion, (notthegrievanceprocedure)shallbetheprop erforumfordiscussionofADAconcernsidentif iedbytheUnion;however, ,induce,support,encourage,orcondonea strike,sympathystrike,work-stoppage,slow down,concertedwithholdingofservice, ,theStatereservesandretains,whetherexerc isedornot,allthelawfulandcustomaryrights , ;determiningthemissionofanagencyandtheme thodsandmeansnecessarytofulfilithatmissi on,includingthecontractingoutof orthe3discontinuationofservices,position s,orprogramsinwholeorinpart;thedetermina tionofthecontentofjobclassification;thea ppointment,promotion,assignment,directio nandtransferofpersonnel;thesuspension,de motion,dischargeoranyotherappropriateact ionagainstitsemployees;therelieffromduty ofitsemployeesbecauseoflackofworkorforot herlegitimatereasons;theestablishmentofr easonableworkrules.

4 , ,directlyorindirectly, (30) memberoftheUnionoranemployeewhosemembers hipis (a) feeasa ,togetherwitha 'compensationorforanypayrollperiodinwhic hearningsreceivedareinsufficienttocovert heamountofdeduction,norshallsuchdeductio nsbemadefromsubsequentpayrollstocoverthe periodinquestion(non-retroactive). , ' , ,specifyingthejurisdictionofeachsteward, OfficeofLabor ,whomayrepresenttheUnioninmatterswhichar eagencywide(orsub-agencywide).Thislangua geshallnotbeconstruedtolimittheUniontoa ,theUnionagreestofollowguidelinesofappro ximatelyone(1)stewardforeachtwenty-five( 25) , ,processingorinvestigatingfiledgrievance s,orfUlfillingtheUnion'sroleascollective bargainingagent,providedthattheyendeavor togivenoticepriortoarrival,orif thatis notpractical, (a) , , theimmediatesupervisorisunavailable, , UnionStewardattheworksite,he/ ,theemployeemayattempttocontacttheStewar dintheeasiest , thecontactshallbemadeinthemannerleastdis ruptivetotheworksituation.(b)UnionStewar dsexercisingtheirresponsibilitiesunderth iscontractandunderStateLaborlawshallnotb elimitedtoa prescribednumberofhoursforreleasetimedur inganyday, ,intheEmployer'sopinion,anysteward(s)is (are)devotinganexcessiveamountoftimetost ewardactivities,representativesoftheUnio nandtheOfficeofLaborRelationswillmeettor eacha mutuallyacceptablesolutionofthematters; ,reallocationofstewardassignments,fullor partialleavesofabsence,asprovidedinArtic le7,SectionEight(b).

5 ,Unionofficers,stewards, ,theUnionofficers,stewardsormembersmay,i f immediateactionisrequiredtoresolvea questionormatterwithinthescopeoftheUnion 'sdutiesasexclusiverepresentative,usethe telephonefacilities, ,uponrequestandadequatenotice, (a)PaidleavemaybegrantedtoUnionofficials ,delegates,representativesordesigneestoa ttendUnionbusinessrelatedfunctions,meeti ngs,conventions,meetingsofnationalaffili atesorotheraffiliatedorganizations, (8,000)hourspercontractyearforpurposesof attendanceattheUnion' (600) (2)weeksinadvance, ' (b)Notmorethantwo(2)employeesfromdiffere ntagencies,whoareelectedorappointedtoa ,theStateemployershalloffertheemployeeth esameorsimilarpositionastheformerpositio nincludingpay,benefits,andduties, possible, thatisnotpossible,thepositionofferedshal lbewithinreasonabledistanceandtheemploye eshallbegivenpreferencetotransferbacktoh is/herformerworksitewhenthereis a suitablevacancy.(c)(1)One(1)employeeelec tedordesignatedbytheUniontoa successoragreementisinplace.(2)TheStates hallpayallsalaryandbenefits,includingHea lth, (3)Onehalfoftheannualworkhourshasalready beendeductedfromtheUnionLeaveBank.

6 (4)Uponrequestfromthestate,theUnionshall makereimbursementforanygrosssalarynotcom pensatedfromtheUnionBusinessLeaveBank(pu rsuanttosubsection[3]).(5)Uponcompletion oftheieaveprovidedforherein,theemployeew illbereinstatedfromleaveofabsence,tothef acilityandshiftfromwhichhe/shewasgranted leave.(6)Theemployeewillcontinueto accrueallvacationtimeearnedtoa maximumof onehundredtwenty(120) (10)daysperyear.(d)TheUnionshallnothavet ochargeattendanceto"blocktime"formeeting soractivitiessanctionedbymanagementrepre sentatives, ,Labor-ManagementCommitteemeetings,Barga iningUnitJobSafetyCommitteeactivities, , month,ateachinstitutionorworklocation,al lnewemployeesshallbereieasedfromwork,if theysodesire,forone(1)hourwithoutlossofp ay, , (2)monthsshalibedeemedtohavethehighestse niorityforpurposesofselectionforlayoff, (a)TheStateagreestocontinueitspracticesw ithrespecttoreleasetimeforAgencyandlocal picnicsandotheragencyorUnionsocialevents .(b)Thereleaseofemployeeswithoutlossofpa yforpicnicsandotheragencysocialeventssha linotbedeductedfromorchargedtoblocktimeh oursunderArticle7 (UnionRights).

7 ThislanguagehasbeenineffectsinceMay1, (a)TheStateagreestoaliowtheUniontousespa ceatStateinstitutionsorfacilitiesforUnio nbusiness,whensuchspaceisavailable,provi ded;(I)Arrangementsaremadeatleasttwenty- four(24)hoursinadvance;and(2)Sucharrange mentsdonotinterrupttheEmployer'sbusiness ;and(3)Atinstitutions,meetingsshalibehel donlyinnon-directpatientcareareas;and(4) TheUnionshalireimbursetheStateforanyactu alcostsIncurredbysucharrangement,suchasc leaning.(b) , 's"personnelfile"or"personnelrecord"isde finedasthatwhichis maintainedattheagencylevel,exclusiveofan yotherfileorrecord,provided,however,ince rtainagencieswhichdonotmaintainpersonnel filesorrecordsattheagencylevel,thedefine dfileorrecordshalibethatwhichis ,onhis/herrequest,bepermittedtoexaminean dcopy,athis/herexpense,anyandallmaterial sinhis/herpersonnelfile,otherthanpreempl oymentmaterialoranyothermaterialthatis 'srecordsuponpresentationofwritten 'spersonnelfileunlesstheemployeehashadan opportunitytosignit (indicatingreceiptofsuchmaterial).

8 If theemployeerefusestosign,a unionstewardorstaffrepresentativeshallsi gnthematerial(indicatingreceipt)andbepro videda ,anemployeemayfilea (18)monthsfromtheissuancedateofsaidmater ial, ,suchgrievancewillbearbitrableonlyif theemployeesuffersloss,prejudice,orif thematerialis ,suspensions, ' ,suchwrittennotesorrecordsshallbeunoffic ialandshallnotbeofferedbytheStateasevide nceinanygrievanceprocedurehearing(s) ,theEmployershallprovidetimeoff,chargeda sworktime,totraveltotheAgencyofficetoexa minethefileorhavethefileorcopiesofitscon tentstimelytransferredtotheemployee' (3)monthspriortotheemployee' serviceratingwillbeconductedbytheemploye e'simmediatesupervisororasupervisorfamil iarwiththeemployee'sworkanddeemedtobequa lifiedto ' ratingof "unsatisfactory"inone(1)categoryorof"fai r"intwo(2)categoriesshallconstitutea ratingof"lessthangood."Priortoissuingan" unsatisfactory"servicerating, "unsatisfactory"inanycategory,theratings upervisorshallstate reasonsand,ifpracticable, ,normallywithinseven(7) (stepraise)a singleunsatisfactoryratingortwo(2)catego ryratingsof"fair" 'sperformance, ,thearbitratorshallnotsubstitutehis/herj udgmentforthatoftheevaluatorinapplyingth erelevantevaluationstandardsunlesstheeva luatorcanbeshowntohaveactedarbitrarily,c apriciously, "fair"and/or"unsatisfactory" serviceratingwheresuchcommentsareinconsi stentwiththerating;however, ' "unsatisfactory"serviceratingshallbegive nuntilaftertheemployeehashada reasonableopportunitytocorrectanydeficie ncy,inanyevent,notlessthanthree(3) ,however,doesnotrestrictmanagement' (a)Managementretainstherighttodeterminet rainingneeds, discussionbetweentheStateandtheUnion.

9 (b)Seniorityshallbethedeterminingfactoru sedbymanagementinselectingemployeesfortr ainingwhenthereisa thenextsessionof thatcourse.(c)ThePartiesmaysponsorothert rainingcourses,seminars, , (a)TheStateshallallocateseventythousand( $70,000) ,onehundredpercent(100%)ofcostoftuition, laboratoryfeesandcommunitycollegeservice feesuptoa maximumofseventy-five percent(75%) accreditedinstitutionsofhigher12educatio n,onehundredpercent(100%)ofcostoftuition ,laboratoryfeesandcommunitycollegeservic efeesuptoa maximumoffiftypercent(50%) 'sworkschedulesoastoaccommodatecoursewor krelatedto employment.(b)TheStateshallallocateeight ythousand($80,000) (c)ConferenceFund.(i)Thirtythousand($30, 000)dollarsshallbeallocatedpercontractye artofinanceattendanceatworkshops,seminar sorconferencesbyemployees, ,seminarsorconferencesmustbeeducationala ndbeneficialtothe employeeandtheagencyandshallnotincludest eward ($1,000)dollarsshallbeallottedforanyonea ttendanceandnoemployeewillattendmorethan twoconferences, feesand/ortravelexpenses,includingsuchit emsasmealsorlodging.

10 (ii)EveryeffortshallbemadebytheStatetoal lowparticipationinsaidworkshops,seminars , (iii)Uponapprovalofa requestunderthisSectionbytheUnionandtheA gencyHead,suchrequestshallbeforwardedtot heComptrollerat leasttwo(2)weeksinadvanceoftheevent.(iv) If anyemployeewhohashada requestapproveddoesnotattendtheworkshop, seminarorconference,promptnoticeofcancel lationshallbeprovidedtotheagency'sbusine ssofficewhichshallpromptlynotifytheCompt rollerofthecancellation.(v)Assoonaspossi blebutnotmorethanthirty(30)daysfollowing theevent,theemployeeshallsubmita claimforreimbursementontheappropriatefor mandrequiredreceiptstothebusinessoffice, (90)daysofthedatea workshop,seminarorconferencewasscheduled ,thefundscommittedforthatactivityshallbe releasedandmadeavailableforothers.(Vi) (d)TheUnionshalibeprovidedwrittenquarter lyreportsshowingamountscommittedand/orpa idforaliaccountsestablishedinsub-section s(a),(b)and(c)above.(e)Funds,whichareune xpendedinonefiscalyear,shalicarryoverint othenextfiscalyear, (a),(b)and(c) ,wherepracticable,apprenticeshipprograms includingthoserecognizedbytheVeteran' (3)representativesoftheUnionandthree(3) ,atminimum,four(4) ,eitherinwholeorinpart,fortime requiredbytheemployertoattendtraining, ,a determinationofunsatisfactoryperformance duringa WorkingTestPeriodshalibetantamounttoafai lureof ,afterfairtrial,theappointingauthorityma yremoveanyemployeeif,intheopinionofsucha ppointingauthority, (a)TheWorkingTestPeriodforjobclassificat ionsinthe14bargainingunitshallbesix(6) ,theWorkingTestPeriodforemployeeswhoarep romotedtonon-competitivepositionsintheba rgainingunitshallbefour(4)months.
