4 FTAproposes the following America RequirementsThe Contractor agrees to comply with 49 40118 (the Fly America Act) in accordancewith the General Services Administration s regulations at 41 CFR Part 301-10, which providethat recipients and subrecipients of Federal funds and their contractors are required to use air carriers for Government-financed international air travel and transportation of theirpersonal effects or property, to the extent such service is available, unless travel by foreign aircarrier is a matter of necessity, as defined by the Fly America Act. The Contractor shall submit,if a foreign air carrier was used, an appropriate certification or memorandum adequatelyexplaining why service by a flag air carrier was not available or why it was necessary to usea foreign air carrier and shall, in any event, provide a certificate of compliance with the FlyAmerica requirements.

5 The Contractor agrees to include the requirements of this Section in allsubcontracts that may involve international air FPage 32. BUY AMERICA REQUIREMENTS49 5323(j)49 CFR Part 661 Applicability to ContractsThe Buy America requirements apply to the following types of contracts: Construction Contractsand Acquisition of Goods or Rolling Stock (valued at more than $100,000).Flow DownThe Buy America requirements flow down from FTA recipients and subrecipients to first tiercontractors, who are responsible for ensuring that lower tier contractors and subcontractors are incompliance. The $100,000 threshold applies only to the grantee contract, subcontracts under thatamount are subject to Buy Clause/LanguageThe Buy America regulation, at 49 CFR , requires notification of the Buy Americarequirements in FTA-funded contracts, but does not specify the language to be used.

6 Thefollowing language has been developed by America -The contractor agrees to comply with 49 5323(j) and 49 Part 661,which provide that Federal funds may not be obligated unless steel, iron, and manufacturedproducts used in FTA-funded projects are produced in the United States, unless a waiver hasbeen granted by FTA or the product is subject to a general waiver. General waivers are listed in49 and includemicrocomputer equipment and software. Separate requirements forrolling stock are set out at 49 5323(j)(2)(C) and 49 Rolling stock must beassembled in the United States and have a 60 percent domestic content.
