2 "Community-basedorganizations"meansanorg anizationthat:(1)providesemployment,skil ldevelopment,or relatedSB2408 EnrolledLRB10211366 BMS 16699bPublicAct 102-0662servicesto membersof thecommunity;(2)includescommunitycollege s,nonprofits,andlocalgovernments;(3)hasa t leastonemainoperatingofficein thecommunityor regionitserves;and(4)demonstratesrelatio nshipswithlocalresidentsand otherorganizationsservingthe community."Department"meansthe Departmentof Commerceand EconomicOpportunity,unlessthetextsolelys pecifiesa particularDepartment."Director"meanstheD irectorof CommerceandEconomicOpportunity."Equityel igiblecontractor"or "eligiblecontractor"means:(1)a businessthatis majority-ownedby equityinvestmenteligibleindividualsor personswho are or havebeenparticipantsin theCleanJobsWorkforceNetworkProgram,Clea nEnergyContractorIncubatorProgram,Return ingResidentsCleanJobsTrainingProgram,Ill inoisClimateWorksPreapprenticeshipProgra m,or CleanEnergyPrimesContractorAcceleratorPr ogram.
3 (2)anonprofitorcooperativethatismajority -governedbyequityinvestmenteligibleindiv idualsor personswhoareor havebeenparticipantsin theCleanJobsWorkforceNetworkProgram,Clea nEnergyContractorIncubatorProgram,Return ingResidentsCleanJobsTrainingProgram,Ill inoisClimateWorksPreapprenticeshipProgra m,orCleanEnergyPrimesSB2408 EnrolledLRB10211366 BMS 16699bPublicAct 102-0662 ContractorAcceleratorProgram;or(3)anequi tyinvestmenteligiblepersonoranindividual whois or hasbeena participantin theCleanJobsWorkforceNetworkProgram,Clea nEnergyContractorIncubatorProgram,Return ingResidentsCleanJobsTrainingProgram,Ill inoisClimateWorksPreapprenticeshipProgra m,or CleanEnergyPrimesContractorAcceleratorPr ogramandwhois offeringpersonalservicesas an independentcontractor.
4 "Equityfocusedpopulations"means(i) low-incomepersons;(ii)personsresidingine quityinvestmenteligiblecommunities;(iii) personswhoidentifyas black,indigenous,andpeopleof color;(iv)formerlyconvictedpersons;(v)pe rsonswhoareor werein thechildwelfaresystem;(vi)energyworkers; (vii)dependentsof displacedenergyworkers;(viii)women;(ix)L GBTQ+,transgender,orgendernonconformingp ersons;(x) personswithdisabilities;and (xi)membersof any of thesegroupswho are alsoyouth."Equityinvestmenteligiblecommu nity"and"eligiblecommunity"aresynonymous andmeanthegeographicareasthroughoutIllin oiswhichwouldmostbenefitfromequitableinv estmentsby the Statedesignedto ,the eligiblecommunitymeansthe followingareas:(1)R3 Areasas establishedpursuantto Section10-40of theCannabisRegulationandTaxAct,whereresi dentsSB2408 EnrolledLRB10211366 BMS 16699bPublicAct 102-0662havehistoricallybeenexcludedfrom economicopportunities,includingopportuni tiesintheenergysector.
5 And(2)Environmentaljusticecommunities,as definedbytheIllinoisPowerAgencypursuantt o theIllinoisPowerAgencyAct,butexcludingra cialandethnicindicators,whereresidentsha vehistoricallybeensubjecttodisproportion ateburdensof pollution,includingpollutionfromthe energysector."Equityinvestmenteligiblepe rson"and"eligibleperson"aresynonymousand meanthepersonswhowouldmostbenefitfromequ itableinvestmentsby theStatedesignedto ,eligiblepersonsmeansthe followingpeople:(1)personswhoseprimaryre sidenceis in an equityinvestmenteligiblecommunity;(2) personswho are graduatesof or currentlyenrolledin the fostercaresystem;or(3) personswho wereformerlyincarcerated.
6 "ClimateWorksHub"meansa nonprofitorganizationselectedby theDepartmentto actas a qualifyas a ClimateWorksHub,the organizationmustdemonstratethe following:(1)theabilityto effectivelyservediverseandunderrepresent edpopulations,includingbyprovidingSB2408 EnrolledLRB10211366 BMS 16699bPublicAct 102-0662employmentservicesto suchpopulations;(2)experiencewiththecons tructionandbuildingtrades;(3)theabilityt o recruit,prescreen,andprovidepreapprentic eshiptrainingtoprepareworkersforemployme ntin the constructionand buildingtrades;and(4) a planto providethe following:(A) preparatoryclasses;(B)workplacereadiness skills,suchas resumepreparationand interviewingtechniques;(C)strategiesforo vercomingbarriersto entryand completionof an apprenticeshipprogram.
7 And(D) cleanenergysectoris a growingareaof the economyin theStateof thecleanenergyeconomyin Illinoiscanbe a vehicleforexpandingequitableaccessto publichealth,safety,a cleanerenvironment,qualityjobs, is in the publicpolicyinterestof the Stateto ensurethatIllinoisresidentsfromcommuniti esdisproportionatelyimpactedby climatechange,communitiesfacingcoalplant orcoalmineclosures,and economicallydisadvantagedcommunitiesSB24 08 EnrolledLRB10211366 BMS 16699bPublicAct 102-0662andindividualsexperiencingbarrie rsto employmenthaveaccesstoStateprogramsandgo odjobsandcareeropportunitiesin growingsectorsof thegrowingcleanenergysector,theGeneralAs semblyherebycreatesthisActto increaseaccessto andopportunitiesforeducation,training,an dsupportservicestheseindividualsneedto succeedin thisActareessentialto equitable,statewideaccessto qualitytraining,jobs,andeconomicopportun itiesacrossthe (a)Subjectto appropriation,theDepartmentshallselect3 uniqueRegionalAdministrators.
8 OneRegionalAdministratorforcoordinationo f theworkin theNorthernIllinoisProgramDeliveryArea,o neRegionalAdministratorforcoordinationof theworkin theCentralIllinoisProgramDeliveryArea,an done RegionalAdministratorfor coordinationof the workin theSouthernIllinoisProgramDeliveryArea.( b)TheRegionalAdministratorsshallhavestro ngcapabilities,experience,andknowledgere latedto programdevelopmentandfiscalmanagement;cu lturalandlanguagecompetencyneededtobeeff ectiveintheirrespectivecommunitiesto be served;expertisein workingin andwithSB2408 EnrolledLRB10211366 BMS 16699bPublicAct 102-0662 BIPOC andenvironmentaljusticecommunities;knowl edgeandexperiencein workingwithemployeror sectoralpartnerships,if applicable,in cleanenergyor relatedsectors.
9 Andawarenessofindustrytrendsandactivitie s,workforcedevelopmentbestpractices,regi onalworkforcedevelopmentneeds,regionalan dindustryemployers, strongpartnershipswithcommunity-basedorg anizationsand labororganizations.(c)TheRegionalAdminis tratorsshallworktogethertoadministerthei mplementationof theCleanJobsWorkforceNetworkProgram,theI llinoisClimateWorksPreapprenticeshipProg ram,theCleanEnergyContractorIncubatorPro gram,andthe (a)As usedin thisSection,"Program"meanstheCleanJobsWo rkforceNetworkProgram.(b) Subjectto appropriation,the Departmentshalldevelopand,throughRegiona lAdministrators,administertheCleanJobsWo rkforceNetworkProgramto createa networkof 13 ProgramdeliveryHubSiteswithprogramelemen tsdeliveredbycommunity-basedorganization sandtheirsubcontractorsgeographicallydis tributedacrossthe Stateincludingat leastoneHubSitelocatedin or neareachof thefollowingareas:Chicago(SouthSide),Chi cago(SouthwestandWestSides),SB2408 EnrolledLRB10211366 BMS 16699bPublicAct 102-0662 Waukegan,Rockford,Aurora,Joliet,Peoria,C hampaign,Danville,Decatur,Carbondale,Eas tSt.
10 Louis,and Alton.(c)In admittingprogramparticipants,foreachwork forceHub Site,the RegionalAdministratorsshall:(1) in eachHub Sitewherethe applicantpoolallows:(A)dedicateatleaston e-thirdofprogramplacementsto applicantswhoresidein a geographicareathatis impactedby economicandenvironmentalchallenges,defin edas an areathatis both(i)an R3 Area,as definedpursuantto Section10-40of theCannabisRegulationandTaxAct,and(ii)an environmentaljusticecommunity,as definedby theIllinoisPowerAgency,excludinganyracia lor ethnicindicatorsusedby theagencyunlessanduntiltheconstitutional basisfortheirinclusionindeterminingprogr amadmissionsis ,preferenceshallbe givento applicantswhofacebarrierstoemployment,su chas loweducationalattainment,priorinvolvemen twiththecriminallegalsystem,andlanguageb arriers;andapplicantsthataregraduatesof or currentlyenrolledin thefostercaresystem.
