4 Where, in any specific case, differentsections of this code specify different materials, methods ofconstruction or other requirements, the most restrictive Building Codedoes not apply to, andno code enforcement action shall be brought with respect to,zoning requirements, land use requirements and ownerspecifications or programmatic requirements which do notpertain to and govern the design, construction , erection,alteration, modification, repair or demolition of public orprivate buildings, structures or facilities or to programmaticrequirements that do not pertain to enforcement of theFlorida Building Code. Additionally, a local code enforce-ment agency may not administer or enforce theFloridaBuilding Code, Buildingto prevent the siting of any publiclyowned facility, including, but not limited to, correctional2010 Florida Building CODE facilities, juvenile justice facilities, or state universities, Florida colleges, or public education facilities, as providedby provisions of theFlorida Building Codeshall apply to the construction , erection, alteration, modifica-tion, repair, equipment, use and occupancy, location, mainte-nance, removal and demolition of every public and privatebuilding, structure or facility or floating residential structure,or any appurtenances connected or attached to such buildings,structures or facilities.

5 Additions, alterations, repairs andchanges of use or occupancy group in all buildings and struc-tures shall comply with the provisions provided in CHAPTER 34of this code. The following buildings, structures and facilitiesare exempt from theFlorida Building Codeas provided by law,and any further exemptions shall be as determined by the legis-lature and provided by law:(a) Building and structures specifically regulated and pre-empted by the federal government.(b) Railroads and ancillary facilities associated with therailroad.(c) Nonresidential farm buildings on farms.(d) Temporary buildings or sheds used exclusively forconstruction purposes.(e) Mobile or modular structures used as temporaryoffices, except that the provisions of Part II ( , Florida Statutes) relating to accessi-bility by persons with disabilities shall apply to suchmobile or modular structures.

6 (f) Those structures or facilities of electric utilities, asdefined in Section , Florida Statutes, which aredirectly involved in the generation, transmission, ordistribution of electricity.(g) Temporary sets, assemblies, or structures used in com-mercial motion picture or television production, or anysound-recording equipment used in such production,on or off the premises.(h) Chickees constructed by the Miccosukee Tribe of Indi-ans of Florida or the Seminole Tribe of Florida . As usedin this paragraph, the term chickee means anopen-sided wooden hut that has a thatched roof of palmor palmetto or other traditional materials, and that doesnot incorporate any electrical, plumbing, or othernonwood features.(i) Family mausoleums not exceeding 250 square feet inarea which are prefabricated and assembled on site orpreassembled and delivered on site and have walls,roofs, and a floor constructed of granite, marble, orreinforced concrete.

7 (j) Temporary housing provided by the Department ofCorrections to any prisoner in the state addition to the requirements of Section , Florida Statutes, facilities subject to the provi-sions of CHAPTER 395, Florida Statutes, and Part II of Chap-ter 400, Florida Statutes, shall have facility plans reviewedand construction surveyed by the state agency authorized todo so under the requirements of CHAPTER 395, Florida Stat-utes, and Part II of CHAPTER 400, Florida Statutes, and thecertification requirements of the federal buildings or structures moved into orwithin a county or municipality shall not be required to bebrought into compliance with the state minimum buildingcode in force at the time the Building or structure is moved,provided:1. The Building or structure is structurally sound and inoccupiable condition for its intended use;2.

8 The occupancy use classification for the Building orstructure is not changed as a result of the move;3. The Building is not substantially remodeled;4. Current fire code requirements for ingress and egressare met;5. Electrical, gas and plumbing systems meet the codesin force at the time of construction and are operationaland safe for reconnection; and6. Foundation plans are sealed by a professional engi-neer or architect licensed to practice in this state, ifrequired by theFlorida Building Code, Buildingforall residential buildings or structures of the sameoccupancy Building official shall apply the same standardto a moved residential Building or structure as that applied tothe remodeling of any comparable residential Building orstructure to determine whether the moved structure is sub-stantially cost of the foundation on which the moved buildingor structure is placed shall not be included in the cost ofremodeling for purposes of determining whether a movedbuilding or structure has been substantially section does not apply to the jurisdiction andauthority of the Department of Agriculture and ConsumerServices to inspect amusement rides or the Department ofFinancial Services to inspect state-owned buildings enforcement district shall be governed by aboard.
