Business meansanycommercialenterpriseorestablishm entoperatingintheCityandCountyof Honolulu,includinganindividualproprietor ship,jointventure,partnership,corporatio n,limitedliabilitycompany,orotherlegalen tity,whetherforprofitornotforprofit,andi ncludesallemployeesof thebusinessoranyindependentcontractorsas sociatedwiththebusiness. Customer meansapersonwhopurchasesmerchandisefroma business. Department meansthedepartmentof environmentalservices. Director meansthedirectorof environmentalservicesorthedirector sdesignee.

Reusablebag meansabagwithhandlesthatisspecificallyde signedandmanufacturedformultiplereuseand ismadeof:(1)clothorotherwashablefabric;o r(2)durablematerialsuitableforreuse, ,bagsmadeof biodegradableplasticorrecyclablepaperbag savailableforsaleorwithoutchargetocustom ersatthepointof (a)Anybusinessviolatinganyprovisionof thisarticleoranyruleadoptedpursuanttothi sarticleshallbe:(1)Orderedto discontinuethedistributionofbagsprohibit edbythisarticleatthepointofsale;and(2)Su bjectto acivilfineofnotlessthan$100normorethan$1 ,000foreachdayof violation.
