3 This publication is a major revi-sion. Summary. This regulation supplements 5 CFR 300 and DODI It estab-lishes the framework for delegation of au-thorities for the conduct of Civilian person-nel matters within the Department of the army . It consolidates certain army policies and procedures relating to Civilian person-nel management. Applicability. This regulation applies to DA Civilian appropriated fund employees, in the competitive and excepted services, and to army Reserve technicians. It does not apply to army National Guard technicians employed under Title 32, United States Code, unless specifically made applicable by the Chief, National Guard Bureau.

4 The Department of the army has several alternate Personnel sys-tems, for which certain portions of this AR may not apply. The affected organizations received approval from Congress, Office of Personnel Management, or the Department of Defense to establish their own Personnel policies and procedures. For those organi-zations, follow the approved guidance in each of the specific Federal Register notices or the alternative Personnel system s inter-nal guidance to qualify, appoint, and pro-mote applicants and employees.

5 Some of these organizations include the demonstra-tion projects and the Defense Civilian Intel-ligence Personnel System. Proponent and exception authority. The proponent of this regulation is the Dep-uty Chief of Staff, G 1. The proponent has the authority to approve exceptions or waivers to this regulation that are consistent with controlling law and regulations. The proponent may delegate this approval au-thority, in writing, to a division chief with the proponent agency or its direct reporting unit or field operating agency in the grade of colonel or the Civilian equivalent.

6 Activ-ities may request a waiver to this regulation by providing justification that includes a full analysis of the expected benefits and must include formal review by the activ-ity s senior legal officer. All waiver re-quests will be endorsed by the commander or senior leader of the requesting activity and forwarded through their higher head-quarters to the policy proponent. Refer to AR 25 30 for specific guidance. army internal control process. This regulation contains internal control provi-sions in accordance with AR 11 2 and iden-tifies key internal controls that must be evaluated (see appendix B).

7 Supplementation. Supplementation of this regulation and establishment of com-mand and local forms are prohibited with-out prior approval of the proponent. Users are invited to send comments and suggested improvements on DA Form 2028 (Recom-mended Changes to Publications and Blank Forms) directly to the Assistant G 1 (Civil-ian Personnel ), (DAPE CPP SC), 6010 6th Street, Building 1465, Fort Belvoir, VA 22060.

8 Committee management. AR 15 39 requires the proponent to justify establish-ing or continuing committee(s), coordinate draft publications, and coordinate changes in committee status with the Administrative Assistant to the Secretary of the army , Analysis and Integration Cell (AAAI CL), 105 army Pentagon, Washington DC, 20310 0105. Further, if it is determined that an established "group" identified within this regulation later takes on the characteristics of a committee as found in AR 15 39, then the proponent will follow AR 15 39 requirements for establishing and continuing the group as a committee.

This publication is availa-ble in electronic media only and is intended for command levels A, B, C, D, and E for the Regular army , the army National Guard of the United States , and the army Reserve.
