4 Witnesseth:WhereasthepartiestothisAgreem entdesiretoestablisha stateofamicableunderstanding,cooperation andharmony;andWhereasthepartiestothisAgr eementconsiderthemselvesmutuallyresponsi bletoimprovethepublicservicethroughincre asedmorale,effi-ciencyandproductivity:No w,therefore, ,Council4,AFSCME, , , (so-called accretions )shallbedeterminedasfollows:(a)TheEmploy ershallnotifyAFSCME inwritingofthenewclassifica-tion,thecont emplatedpaygroup(ifany)andtheEmployer point-factorevaluationsystemaspartofthes alarydeterminationprocessfornewlycreated classes.(b)Withinthirty(30)calendardaysa fterreceiptoftheabovenotifica-tion,theUn ionmayrequesta meetingtodiscusscoverageand/orpaygroupis sues.

5 (c)Indeterminingcoverage,controllingweig htshallbegiventocon-formingtheplacemento fthenewclassificationtothecontoursofthee xistingunit.(d)Disputesconcerninghowtoac hievesuchconformityshallbereferredtotheC onnecticutStateBoardofLaborRelationsfort heexerciseofitsjurisdictiontodetermineap propriateunits.(e)TheEmployershallnotify AFSCME inwritingofanySupremeCourtaction(s)thats ubstantiallychangeanyunitjobclassificati on.(f)UponrequestbytheUnion,(withinthirt y(30)calendardaysafterreceiptofnotificat ion),a jointLabor-ManagementCommitteeshallevalu -atethenewlycreatedorsubstantiallychange dunitjobclassification(s),todeterminethe accuracyoftheBranch agreementcannotbereachedthroughtheLabor- ManagementCommitteeprocess,a mutuallyagreeduponarbitratorfamiliarwith theWillisSystem,shallmakea ,orlawfulactivityinbehalfof, above:(a)Anemployee,theUnion, (b)If therequirementsofparagraph(a)havebeenmet ,andtherehasbeennoreasonableoffertodisav oworotherwisecureanyperceiveddiscriminat ion,a grievancemaybefiledatanappropriateStep.

6 (c)Inanyarbitrationproceedingalleginga violationofSection1,theArbitratorshallde terminewhetherthegrievanthasshownbya fairpre-2ponderanceoftheevidence,includi ng,whereappropriate,thesur-roundingcircu mstances, theobligationsofSection2(a)and2(b) IntheeventthatEEOC rendersa rulingaffectingtheseprovisions,eitherpar tymayrequesta NoLockoutsSection1.(a)Theexclusiverepres entativeshallnotengagein,induce,support, encourageorcondonea strike,sympathystrike,workstoppage,slow- down,concertedwithholding,interruptionor disruptionofservices,sick-out, (b)Similarly,employeesshallnotengagein,i nduce, ,uponratification, ,ratified, ,eachhadtheunlimitedrightandopportunityt omakedemandsandproposalswithrespecttoany subjectormatternotremovedbylawfromtheare asofcollectivebargaining,andthattheunder standings, ,theJudicialBranchandtheUnion,forthedura tionofthisAgreement,eachvoluntarilyandun qualifiedlywaivestheright,andeachagreest hattheothershallnotbeobligatedtobargainc ollectivelywithrespectto.

7 1)anysubjectsormattersreferredtoorcovere dinthisAgreement,or2)anysubjectsormatter snotreferredtoorcoveredinthisAgreement, ,asanindependentbranchofstategovernment, inassuringcompli-ancewiththelaws,theCons titutionoftheStateofConnecticut, sservices,includingthegeneralpublic,dema ndthepromptandefficientadjudicationofcom plaintsanddisputes,andinsistuponthefulle stprotectionofstatutory,civil, ,specificprovisionofthisAgreementprovide sother-wise,theConnecticutJudicialBranch ,actingthroughtheJusticesoftheSupremeCou rt,theChiefCourtAdministrator,(and,where appropriate,thePublicDefenderServicesCom mission),andsuchotherjudgesandofficialsa smaybeauthorizedtoactontheirbehalf,retai nsalltherightsandprerogativesithadpriort othesigningofthisAgreementeitherbylaw,cu stom,practice,usageorprecedent, ,includingestablishingqualificationsfora bilitytoperformworkinclassesand/orrating s;determiningitsbudget,itsmission,andthe methods,meansandpersonnelnecessarytofulf illthatmission,includingthecontractingou t,orthediscontinuationofservices,positio ns,orprogramsinwholeorinpart;thedetermin ationofthecontentofjobclassifications;th eappointment,promotion,assignment,direct ionandtransferofpersonnel.

8 Suspending,demotion,discharging,ortaking anyotherdisciplinaryactionforjustcauseun derArticle14;thelayoffofitsemployeesbeca useoflackofworkorotherlegitimatereasonsa sstatedinArticle15;todeterminethehours,d ayswhen,andlocationswherethecourtswillbe inoperation;toenforceexistingrulesandreg ulationsforthegovernanceoftheBranchandto addto,eliminate,ormodifysuchrulesorregul ationsasit deemsappropriate; ,when,andhowtoexerciseitsprerogatives, ,thefailuretoexerciseanyrightshallnotbed eemeda (30) (30)daysafterinitialemploy- ,provided,however,nosuchpaymentshallbere quiredbyemployees;1)whosemembershipinthe Unionisterminatedforreasonsotherthannon- paymentofUniondues.
