1 CriminalOffences (Amendment) Act, ( amendment )ACT, 2012 ANACTto amendtheCriminalOffencesAct,1960(Act29)t o includethe offencesof unlawfuluse of humanparts,enforceddisappearance,sexuale xploitation,illicittraffickingin explosives,firearmsandammunition,partici pationin an organisedcriminalgroup,racketeeringandto providefor :27hJune, Parliamentandassentedto by the President:Section69B inserted1. Theprincipalenactmentis amendedby the insertionaftersection69 Aof section69 B:"Unlawfuluse of personwhowithoutlawfulauthority,the proofof whichlieson thatperson,(a)engagesin the removalof humanparts;(b)is in possessionof humanparts;(c)engagesin thedrainingof humanblood;or(d)is in possessionof humanblood2 CriminalOffences (Amendment) Act, 2012 Act849commitsa seconddegreefelonyandis liableon summaryconvictionto atermof imprisonmentof notlessthanfiveyearsandnotmorethantwenty -fiveyears.

2 (2)Forthepurposesof subsection(1),"humanparts"includesadisti nctinternalor externalorganof the humanbodyor humanblood".Section95A inserted2. Theprincipalenactmentis amendedby theinsertionaftersection95 of section95A."Enforceddisappearance95A.(1) A personshallnotcausetheenforceddisappeara nceofanotherperson.(2)A personwhocausestheenforceddisappearanceo fanotherpersoncommitsan offenceandis liableon convictiontoa maximumpenaltyof lifeimprisonmentanda minimumopenaltyof fiveyearsimprisonment.(3)Subsections(1) and(2) applyto a personwhoactswiththeauthorisation,suppor tor acquiescenceof thegovernment.(4)Forthepurposeof thissection,a personcausestheenforceddisappearanceof anotherpersonif thatpersonarrests,detains,abducts,kidnap sor by anyothermeansrestrictsthe movementof thatotherperson,by confiningthatotherpersonin a mannerthat(a)deprivesthatotherperson,of thatotherperson'sliberty;(b)concealsthe fateor whereaboutsof thatotherperson;or(c)placesthatotherpers onoutsidethe protectionof thelaw".

Theprincipalenactmentis amendedby theinsertionaftersection101of section101A"Definitionof sexualexploitationIOIA.(1)Sexualexploita tionis theuseof a personfor sexualactivitythatcausesor is likelyto causeseriousphysicalandemotionalinjuryor in prostitutionor pornography.(2)A personwhosexuallyexploits3 Act849 CriminalOffences (Amendment) Act, 2012 (a)an otherpersonotherthana childcommitsan offenceandis liableon summaryconvictionto a termof imprisonmentof notlessthanfiveyearsandnotmorethantwenty -fiveyears;or(b)anotherpersonwhois a childcommitsan offenceandisliableon summaryconvictionto a termof imprisonmentof notlessthansevenyearsandnotmorethantwent y-fiveyears."Section192 A inserted4. 4 "illicittraffickingin explosives,firearmsand ammunition192A.(1)A personwhotrafficksin explosives,firearmsandammunitioncommitsa seconddegreefelonyandis liableonsummaryconvictionto a termof imprisonmentof notlessthanten years.(2)Traffickingincludestransporting ,tradingor dealingin explosives,firearmsandammunitioneitherdi rectlyor indirectlyfor financial,materialor someotherbenefit."Section200 Aand 200 Binserted5. Theprincipalenactmentis amendedby theinsertionaftersection200of sections200 Aand200B"Organisedcriminalgroup200A.(1)A personwhoparticipatesin an activityof anorganisedcriminalgroupcommitsan offenceandis liableonconvictionto a maximumpenaltyof deathandto a minimumpenaltyof notlessthanfiveyearsimprisonment.

5 "(2)Anorganisedcriminalgroupis a structuredgroupactingin concertwiththe aimof committinga seriousoffence."(3)Forthe purposesof thisAct(a)"seriousoffence"meansan offencefor whichthemaximumpenlatyis deathandthe minimumpenaltyis imprisonmentfor a periodof notlessthanfiveyears;and4 CriminalOffences (Amendment) Act, 2012 Act849(b)"structuredgroup"consistsof twoor morepersons,thatis notrandomlyformed,for thecommissionof an offence,andin whichthemembersmayormaynothavedefinedrol es,continuityof member-shipor whichmayormaynothavea developedstructure.""Racketeering200B.(1 )A personshallnotengagein racketeering.(2)A personwhoengagesin racketeeringcommitsanoffenceandis liableon convictionto a maximumpenaltyof lifeimprisonmentanda minimumpenaltyof notlessthanfiveyearsimprisonment.
