9 "Abuser or Neglector" means any person who is found to have committed the ABUSE or NEGLECT of a child pursuant to Chapter 15 ( et seq.) of Title of the Code of Virginia . The VAC establishes four (4) categories of ABUSE or NEGLECT , including: Physical ABUSE . Physical NEGLECT (includes medical NEGLECT ). Mental ABUSE or NEGLECT . Sexual ABUSE . 10 Child and Family Services Manual C. Child Protective Services Injury and threat of injury or harm to a child Inherent within each category of ABUSE or NEGLECT is an actual injury or the existence of a threat of an injury or harm to the child. Although there are five categories of ABUSE or NEGLECT , there are only two kinds of injuries possible; an injury may be a physical injury or a mental injury. Also, an injury may be an actual injury or a threatened injury. The threat of injury has been upheld by the courts. 1. The CPS worker must consider the circumstances surrounding the alleged act or omission by the caretaker influencing whether the child sustained an injury or whether there was a threat of an injury or of harm to the child.
