1 CONDITIONS OF TENDER VALIDITY PERIOD: The TENDER VALIDITY Period is the period (fromTechnical Bid opening date) within which the Undertaking is required to enter intocontract with the successful tenderer. 2 CONCEPT: Certain items procured by the Undertaking are similar innature and require more or less the same capabilities for production. Such itemswhich are similar in nature shall be considered to be of one family. Sometimes,items within a family though similar, require higher manufacturing/technicalcapabilities, especially when the items are of higher ratings. The family conceptwill be applied for classifying the category of vendors as Regular & New SUPPLIERS: Regular Suppliers are those who have supplied the material against trial/bulkorders of the Undertaking with satisfactory performance. The classification as'Regular suppliers shall imply that such suppliers should have supplied trial/bulkquantity to the Undertaking against at least one Purchase Order in the last 5years.

3 The 'Regular' suppliers of items coming under one family shall be treatedas 'Regular' suppliers for other items of the family, if they have supplied any oneitem in trial/bulk in the past. The 'Regular' suppliers for materials of higher ratingshall be considered as 'Regular' suppliers for materials of lower rating under onefamily. Further, Original Equipment Manufacturer (OEM) or their suppliers Dealers/Distributors shall be treated as Regular suppliers though theyhave not supplied such materials to the Undertaking directly. The same conceptshall also be made applicable for the items having standardized brands which arefield tested and whose performance is found satisfactory. , in case of certain critical items, the 'New' suppliers who have suppliedthe material against trial/bulk orders of the Undertaking which are required toqualify with satisfactory performance in the Undertaking's Field Trial Performancetests (as per pre-declared performance parameters), shall be considered as a'Regular' supplier only after completion of field trials with SUPPLIERS: The 'New' suppliers are those who are having adequate technical capabilities forproducing/manufacturing/servicing the goods/services as per the Undertaking'squality requirements and standards but have never supplied to the Undertaking inthe past.

4 A supplier shall also be treated as 'New' supplier, if the tendered itemunder consideration for procurement is not within the family of such item. CONCERN:The business entity substantially owned by a person having common interest inmore than one business concern of similar nature as partners/ need is felt to define Sister Concern especially to curb any tendency of vendorsto cheat/defraud the Undertaking in cases such as non-execution of contract byone firm and to avoid penal action, the defaulting firm stops dealing with theUndertaking and participate in future tenders of that particular item through theirSister Concerns. OF TENDER : Time is the essence of the TENDER . This TENDER is for thesupply to the Brihan-Mumbai Mahanagarpalika for the purpose of the Brihan-Mumbai Electric Supply and Transport Undertaking (hereinafter referred to as the"Undertaking") of the Stores/Services or any part or portion thereof tendered forby the tenderer (hereinafter referred to as the "Contractor") and accepted by theAssistant General Manager (Materials) or any other officer duly authorized in thatbehalf of the Undertaking at the rates and delivered to the places at and withinthe time specified and without any extra charges or expenses to the Undertakingother than those mentioned in the TENDER .

5 Should quote their rates in figures per unit specified in the e- TENDER bycarefully punching in the appropriate field. quoted rate should clearly charges for container and charges necessary to effect delivery of the supplies, at the depot of theUndertaking or at specified sites freight, insurance, loading and unloading,clearing charges, Goods & Service Tax (GST) etc., the percentage/amount ofwhich should be clearly indicated by tenderer. Unless specifically mentioned, itwill be presumed that quoted rate is inclusive of GST and other charges statedabove and no variation whatsoever will be allowed GST is included in the basic quoted rate, then the tenderer should indicate the% of such GST by selecting the appropriate option (GST included in Rate) fromdrop down menu.

6 If the tenderer does not indicate % of GST included in basicquoted rate, any claim for revision in price due to subsequent change in GST forwhatsoever reason, will not be subsequent variation in the rates will be allowed on grounds such as error,misunderstandings, are prohibited from making any additions, alterations in the descriptionof articles mentioned in the TENDER or in the column for units. In case thespecifications/descriptions mentioned by the tenderer are incomplete, thespecifications/descriptions given in the TENDER , shall be binding for quality andspecifications of received with hedging conditions such as Offer subject to availability ofstock , Offer subject to confirmation at the time of order , Rate subject to marketfluctuation , etc.

7 Shall be TENDER VALIDITY Period as mentioned in the TENDER is the period withinwhich the Undertaking is required to enter into contract with the successfultenderer. On expiry of such period, the rates quoted in the TENDER are not bindingupon the tenderer. Contract VALIDITY Period shall also be mentioned in the TENDER and it willbe binding on the supplier for the faithful execution of contract as per thecontractual terms for the entire ordered quantity including 25% quantity. shall quote unconditionally 'Firm' prices. ORTenderers shall quote 'Variable' prices as per the Undertaking's Price Variation Formula.(Specific applicability of 'Firm' or 'Variable' price to a TENDER ismentioned in the Instructions to Tenderers/ TENDER document).

8 In price due to change in Goods & Service Tax (GST) will be consideredonly if the tenderer specifically mentions rates of GST applicable at the time ofquotation and produces necessary documentary evidence of such variation at thetime of claiming the tenders shall be submitted through the e-tendering system and tenderers shalltake utmost care while quoting rates, GST, other charges, if any, as nosubsequent revision will be allowed after the bid end tenderer shall upload/submit his TENDER documents by selecting the validDigital Signature Certificate of Class-III Company Type-B. Tenders uploadedwithout proper Digital Signature Certificate shall not be are restricted in e- TENDER to modify their price bids once , tenderers are allowed if they desired, to withdraw their existingsubmitted price bids and to re-submit their new price bids till the bid end tenderers are advised to note the new quotation ID generated by the systemas confirmation of successful submission of their new price bids.

9 On exercisingthe re-submission of new price bid option, all earlier bids shall stand null the offer is for stores to be imported specifically for the Undertaking, thetenderers shall quote the price for delivery at the Undertaking s Depot in `indicating the Cost, Insurance, Freight ( ) Mumbai price in the relevantforeign currency and the rate of exchange applicable at the time of quoting. Theyshould also indicate the item-wise landed cost price in Indian currency fordelivery in Mumbai at Undertaking s Depot, clearly indicating agency commission, if payable separately, with the rate thereof. (The Undertaking would prefer to pay it in `). rate of import duty etc. and incidence case, if any import license is required, the same shall be provided by SAMPLE: if called (as mentioned in the Instructions toTenderers/Mandatory Pre-qualification criteria of the respectivetender), shall be submitted free of cost on or before bid end date.

10 If the sampleis not submitted on or before bid end date, the Undertaking will not send anyreminder letter for submission of sample and such offers will not be consideredand ranked. Further, the tenderers should give only one technical offer, dulybacked by sample, (no. of pieces or quantum per sample will be as per thetender condition) for the said offer. Sample should be sealed and affixed withlabel showing (a) TENDER No. (b) Due Date of TENDER (c) Item No. (d) BriefDescription of Sample and (e) Name and Address of the Firm. The sample costing`1,000/- or less shall not be returned to the tenderers. Sample costing more than`1,000/- shall be collected by the tenderers from the depot of the Undertakingafter finalization of the TENDER within 15 days from the date of Undertaking sletter, failing which, the same will be credited to Undertaking s Scrap Yard fordisposal.
