Publication Below is information on when this version of the guidance was published: version published for Home Office staff on 14 January 2022 Changes from last version of this guidance This guidance has been amended to reflect changes to the initial age assessment policy following the judgment of the Supreme Court in R (BF (Eritrea)) v Secretary of State for the Home Department [2021] UKSC 38 which held that the Home Office initial age assessment policy of treating individuals as adults where their physical appearance and demeanour very strongly indicated that they were significantly over 18 years of age was lawful.

10 The list of immigration Removal Centres has been updated to reflect the opening of Derwentside IRC in December 2021, and the closure of Morton Hall. Explanations of the role of the Detention Gatekeeper and the role of the Rule 35 team have been added to the guidance, and clarifications have been made to removal timescale references to ensure alignment with the Hardial Singh principles.
