1 A DIPLOMAT GROUP Company DIPLOMAT GROUP - TERMS AND CONDITIONS The following information and CONDITIONS constitute your binding contract DIPLOMAT GROUP Services LLC, its corporate parents, subsidiaries, affiliates, directors, employees, officers and agents (hereinafter referred to jointly, severally and collectively as DIPLOMAT GROUP ). 2 C) Captain means the lead pilot who has operational control of the aircraft d) Carrier means the approved airline operating on behalf of DIPLOMAT GROUP to provide USG/RSM support services e) Client means TMC or specific companies/employees/passengers (who are purchasing travel solutions from DIPLOMAT GROUP in support of USG/RSM) f) Fit to Fly means document or certificate completed by a medical doctor authorizing a Passenger with a medical condition/injury to travel on the aircraft g) Passengers means a person authorized to travel in accordance with these TERMS and CONDITIONS and the Passenger Booking Agreement, for whom DIPLOMAT GROUP has provided travel solutions (per seat, hotel, visa or any other transport arrangement) and who is USG/RSM accredited and sponsored and covered by the. US BSA/NATO SOFA dated 30 September 2014 and HQ RSM s (CJ4) Contract Air Services Policy dated 23 October 2011).

3 Passengers must be able to provide suitable verification of the above at the time of booking by supplying one of the following: Badge Number (RSM/DOD/CAC card/applicable Base badge): or A copy of an LOA (Letter of Authority); or Purpose of visit and proof of Escort with contact details, (primary and secondary phone numbers for verification) h) Passenger Booking Agreement means an agreement that includes specific TERMS of an individual Passenger s travel which includes the flight itinerary and may include additional TERMS of the Client Transport Agreement (if applicable). i) Passenger rate means the price for the Passenger seat on DIPLOMAT GROUP charter service j) Passenger seat means the individual seats on the aircraft k) RSM means US/NATO s Resolute Support Mission headquartered in Kabul l) Skyline means the reservations system used by the authorised Clients to reserve Passenger seats and issue e-itineraries on DIPLOMAT GROUP charter service m) TERMS and CONDITIONS means the specific TERMS and CONDITIONS applicable to the arrangement for the purchase of Passenger seats on DIPLOMAT GROUP charter service; DIPLOMAT GROUP Standard TERMS and CONDITIONS ; TERMS of the separate Client Transport Agreement, if any; as well as all CONDITIONS as applied by any applicable international commercial carrier / third party service provider in respect of additional transport solutions requested by the Clients, such as hotels, visas, meet and greet etc.

4 N) US BSA & NATO SOFA mean the respective US Bilateral Security Agreement and NATO Status of Forces Agreement dated 30 September 2014 o) USG means the United States Government SERVICES TO BE RENDERED DIPLOMAT GROUP undertakes to provide transportation solution services in support of USG/RSM on DIPLOMAT GROUP charter flights from the airports of origin to the airports of destination, as outlined in applicable flight timetables (which are subject to change at the discretion of DIPLOMAT GROUP ) including as applicable, additional services such as International commercial airline tickets, hotel reservations, holiday packages, Meet and Greet services, etc. PAYMENT TERMS AND SETTLEMENT The booking and payment for seat reservations will proceed as follows: All clients/passengers reserving a Passenger seat must provide appropriate documentation authorizing travel in support of USG/RSM. Failure to provide this information at the time of booking will result in the reservation not being processed A DIPLOMAT GROUP Company All payments shall be made in United States Dollars.

5 Prices are dependent on a variety of variable factors including, but not limited to, fuel costs, rates of exchange and other factors. Should these costs increase, DIPLOMAT GROUP reserves the right to increase the price of any of our services from prices previously published. Every effort will be made to advise you of any price increase at least 15 days prior to your departure date. DIPLOMAT GROUP reserves the right to deny a price match guarantee. To check our current pricing please consult directly with a Travel Specialist at If paying by CASH or CREDIT CARD: Visa / Master / American Express accepted Please note the charge on the Visa/Master credit card will be indicated as DIPLOMAT GROUP SER ANNAPOLIS MD EXCHANGE. Please inform your bank of this (if applicable) in order to prevent the transaction from being declined. Payment confirms all applicable reservations (flight fares and additional services) If paying by CREDIT FILE: (for corporate clients, GROUP bookings or frequent bookers) Lump sum payment is made up front.

6 Each time a booking is made, the flight fare is automatically deducted from the balance. Clients are notified of their balance each time they log-on to the system Bookings can be managed online/real time with the ability to generate a record of the flights (and other services) booked at any time. If paying by WIRE TRANSFER: The fare should be received in DIPLOMAT GROUP account 72 hours before the flight. If this has not been received at that time, cash payment (and cash payment rules) will be assumed. A $25 bank charge must be added to the total payment due when wire transfer is used ( DIPLOMAT GROUP bank details will be supplied as applicable) * Payment confirms all applicable reservations (flight fares and additional services) All payment shall be in full without any deduction, set-off, counter claim, discount, abatement or withholding whatsoever in accordance with TERMS and CONDITIONS (payment TERMS and CONDITIONS in a Client Transport Agreement if applicable supersede other conflicting TERMS and CONDITIONS with the Client Transport Agreement taking the highest precedence).

7 Any dispute or claim shall be dealt with separately. RESERVATIONS AND TICKET DISTRIBUTION The Client/TMC or agent making the booking on behalf of a passenger (as applicable) is responsible for the distribution of all necessary Passenger itineraries, tickets and booking information to applicable Passengers, and for ensuring each Passenger has reviewed these DIPLOMAT GROUP TERMS and CONDITIONS as well as the Carrier s CONDITIONS of Carriage as applicable, and shall keep DIPLOMAT GROUP and the Carrier indemnified against all claims, demands, liabilities, actions, proceedings and costs which arise from any failure of the Client/TMC or agent to do so. For operational reasons and to ensure on time departures, reservations should be made at least 6 hours or more, prior to departure. Any reservations attempted less than 6 hours prior to departure will be accepted on a case by case basis, with the understanding that applicable refreshments may not be available to passengers reserved under these circumstances.

8 On behalf of the Client/TMC or agent or individual passenger in support of USG/RSM - DIPLOMAT GROUP as applicable arranges with airlines, hotels, transfer companies, baggage handlers and other independent suppliers to provide clients with the services purchased. DIPLOMAT GROUP exercises due care in selecting these companies with respect to their performance and reliability. However, DIPLOMAT GROUP has no direct or indirect control over these suppliers and thus DIPLOMAT GROUP cannot be held responsible for their performance or lack thereof. DIPLOMAT GROUP shall not be held responsible for any injury, loss or damage whether mental, emotional or physical howsoever sustained, resulting or arising from any error, omission or negligence of any company or person, agent, employee or sub contractor supplying any of these services as part of your DIPLOMAT GROUP services. DIPLOMAT GROUP as the agent does not assume responsibility for any claims, losses, damages, costs or expense arising out of personal injury or death, loss of enjoyment, upset, disappointment, illness, distress or frustration whether physical, emotional or mental, resulting from or arising out of any of the following: Any negligent act or omission by the airlines, transportation companies, hotels/resort properties or other suppliers, or their personnel or any company or person not under DIPLOMAT GROUP direct control.

9 Government actions, weather, equipment failure, labor disputes, sickness, theft or any other cause beyond our direct control. Failure of the Passenger to obtain the necessary documentation or meet the required health regulations in order to complete their travel arrangements. Failure of the Passenger to arrive at the airport within the time frame stipulated by DIPLOMAT GROUP on the day of departure whether due to missed connections, adverse weather CONDITIONS , mechanical failures or any other reason whatsoever. A DIPLOMAT GROUP Company The need for DIPLOMAT GROUP to change itineraries or substitute accommodation or services, provided that every effort is made to supply the most comparable services and accommodations available. Passenger itineraries once issued are considered confirmed and are non-transferable and no Passenger name change will be accepted. Bookings may be cancelled or changed up to 24hrs prior to departure and a new booking made.

10 Bookings that are cancelled or changed within 24 hours but greater than 3 hours of departure will be charged 50% of the fare and all applicable surcharges, as well as a $20 fee (if applicable) will be charged for a new booking. Cancellations or changes within 3 hours of departure are considered no shows and 100% of the fare charged and retained by DIPLOMAT GROUP . This policy can only be amended in writing in the form of a separate Client Transport Agreement as applicable Bookings for Afghan Nationals cannot be made using Skyline, but, subject to presentation of all required US endorsed documents/proof of badging in support of USG/RSM and any other requirement as stipulated by authorities, DIPLOMAT GROUP or the Carrier, the Client may make such bookings directly with the travel team. PASSENGER RESPONSBILITIES All Passengers are required to be at the check in counters at the appropriate times.
