Notice is hereby given that the DRAFT will be taken into consideration by the government on or after the expiry of a period of thirty days from the date of publication of this notification in Official Gazette, together with any objection or suggestion with regard to the said Bye-laws, which may be received by the Additional Chief Secretary of government of PUNJAB , department of local government , Chandigarh, from any person, before the expiry of the period so specified. DRAFT BYE-LAWS CHAPTER I TITLE AND COMMENCEMENT These Bye-Laws may be called the PUNJAB MUNICIPAL BUILDING Bye-Laws, 2017 . These shall come into force on such date, as the government may by notification, appoint.

3 These Bye-Laws shall apply to the BUILDING activity in MUNICIPAL areas of all MUNICIPAL Corporations/Councils / Nagar Panchayats or to such other areas, as the State government may extend by notification in the official gazette. CHAPTER II DEFINITIONS Abut: A BUILDING is said to abut on a street when the outer face of any of its external walls is on the street, road boundary. Access: A clear approach to a plot or a BUILDING . Act: Means the PUNJAB MUNICIPAL Corporation Act, 1976/ PUNJAB MUNICIPAL Act, 1911. DRAFT PUNJAB MUNICIPAL BUILDING BYELAWS 2017 Page 2 of 130 Addition and Alteration/or Re-erection: A change from one occupancy to another, or a structural change including an addition to the area or change in height or the removal of part of BUILDING , or any change to the structure, such as the construction or removal or cutting into of any wall or part of a wall, partition, column, beam, joist, floor including a mezzanine floor or other support, or a change to or closing of any required means of access ingress or egress or a change to fixtures or equipment as provided in these Bye-laws.

4 Advertising Sign: Any surface or structure or structure with characters, letters or illustrations applied thereto and displayed in any manner whatsoever outdoors for the purpose of advertising or giving information or to attract the public to any place, person, public performance, article, or merchandise, and which surface or structure is attached to, forms part of , or is connected with any BUILDING , or is fixed to a tree or to the ground or to any pole, screen, fence or hoarding or displayed in space, or in or over any water body included in the jurisdiction of the Authority. Air-conditioning: The process of treating air so as to control simultaneously its temperature, humidity, purity, distribution and air movement and pressure to meet the requirements of the conditioned space.

5 Amenity: Includes roads, street, open spaces, parks, recreational grounds, play grounds, gardens, water supply, electric supply, street lighting, sewerage, drainage, public works and other utilities, services and conveniences. Apartment: Apartment shall have the same meaning as defined in the PUNJAB Apartment and Property Regulation Act, 1995. Applicant: Applicant shall mean the person who gives a notice to the Competent Authority of his/her intention to erect or re-erect a BUILDING and shall include his/her legal representatives. Architect: Architect shall have the same meaning as assigned to it in the Architects Act, 1972. Architectural Control: Means control of horizontal/vertical projections from the walls of the BUILDING and to restrict the height on any site exposed to the view from the street/road.

6 Similarly architectural control sheets shall mean sheets/drawings with directions as mentioned above and signed and retained by competent authority Area in relation to the BUILDING : Means the superficial or a horizontal section thereof made at plinth level inclusive of the external walls and of such portion the party walls as being of the BUILDING . BUILDING : Means walled and roofed structure built for temporary or permanent use either for habitation or for storage or for an industry or for business use. (a) Addition to the BUILDING : Means the addition to the cubic contents or to the floor area of the BUILDING . (b) Ancillary BUILDING in the residential area: Shall mean a BUILDING attached to or serving the main residential BUILDING and shall include buildings such as garage, store, rooms, fuel store, servant quarter but shall not include annex or a guesthouse capable of use as independent dwelling unit.

7 DRAFT PUNJAB MUNICIPAL BUILDING BYELAWS 2017 Page 3 of 130 (c) Ancillary BUILDING in an industrial area: Shall mean BUILDING ancillary to or serving the main industrial BUILDING and shall include administrative BUILDING , godowns, cycle sheds, dispensary, canteen, electric sub-station and quarters to watch and ward staff, but shall not include residential accommodation for the superior staff. (d) Categories of BUILDING : Shall mean a BUILDING in one of the following categories: i) Residential BUILDING (plotted and group housing) ii) Commercial BUILDING iii) Industrial or warehouse BUILDING iv) Public BUILDING / Institutional BUILDING v) Mixed land use BUILDING vi) Nursing home / Hospital BUILDING vii) Marriage palace BUILDING viii) Multiplex BUILDING Types of Buildings based on use of premises or activity : a.

8 Commercial BUILDING - Shall mean a BUILDING other than industrial BUILDING used or constructed or adopted to be used wholly or partially for shops, private offices, banks, hotels, restaurants/banquet halls, beauty parlors, boutiques, video parlors, cinemas and auditoriums or any other such BUILDING used for similar purpose engaged in trade and commerce, but shall not include nursing homes, hospitals, marriage palaces and multiplexes. b. Educational BUILDING - Includes a BUILDING exclusively used for a school or college, recognized by the appropriate Board or University, or any other Competent Authority involving assembly for instruction, education or recreation incidental to educational use, and including a BUILDING for such other uses as research institution.

9 It shall also include quarters for essential staff required to reside in the premises, and BUILDING used as a hostel captive to an educational institution whether situated in its campus or outside. c. Industrial BUILDING - Includes a BUILDING or part thereof wherein products or material are fabricated, assembled or processed, such as assembly plants, laboratories, power plants, refineries, gas plants, mills, diaries and factories etc. d. Mixed Land Use BUILDING - A BUILDING partly used for non-residential activities and partly for residential purpose. e. Residential BUILDING - Includes a BUILDING in which sleeping and living accommodation is provided for normal residential purposes, with cooking facilities and includes one or more family dwellings, apartment houses, flats, and private garages of such buildings.

10 Types of buildings based on design and height: a. Detached BUILDING - Includes a BUILDING with walls and roofs independent of any other BUILDING and with open spaces on all sides within the same plot. Multi-Storeyed BUILDING or High Rise BUILDING - A BUILDING above 4 stories, and/or a BUILDING exceeding 15 meters or more in height (without stilt) and (including stilt). c. Semi-detached BUILDING - A BUILDING detached on three sides with open space as specified within the same plot. Types of buildings based on other features: a. Special BUILDING - Includes all buildings like assembly, industrial, buildings used for wholesale establishments, hotels, hostels, hazardous, mixed occupancies with any of the aforesaid occupancies and centrally air conditioned buildings having total built up area exceeding 500 sq m.
