6 ARTICLE 1 UNION RECOGNITIONS ection RecognitionThe Employer recognizes the Union designated below as the exclusivebargaining representative of all employees in the bargaining unit forwhich the Union has been recognized and certified at the National level: National postal Mail Handlers Union, a Division of the Laborers Inter- National Union of North America, AFL-CIO Mail ExclusionsThe bargaining unit set forth in Section 1 above does not include, andthis Agreement does not apply to:AManagerial and supervisory personnel;BProfessional employees;CEmployees engaged in personnel work in other than a purelynon-confidential clerical capacity;DSecurity guards as defined in Public Law 91-375, 1201(2);EAll postal Inspection Service employees;FEmployees in the supplemental work force as defined inArticle 7;GRural Letter Carriers;HCity Letter Carriers;IMaintenance Employees;JSpecial Delivery Messengers;KMotor Vehicle Employees;LPostal Clerks;MMail Equipment Shop employees.

7 OrNMail Transport Equipment Centers and Supply Center Facility ExclusionsThis Agreement does not apply to employees who work in other em-ployer facilities which are not engaged in customer services and mailprocessing, previously understood and expressed by the parties to meanmail processing and delivery, including but not limited to Headquarters,Area Offices, postal Data Centers, postal Service Training and Devel-opment Institute, Oklahoma postal Training Operations, postal Acade-mies, postal Academy Training Institute, Stamped Envelope Agency,Supply Centers, Mail Equipment Shops, or Mail Transport EquipmentCenters and Repair DefinitionSubject to the foregoing sections, this Agreement shall be applicable toall employees in the regular work force of the postal Service, as de-fined in Article 7, at all present and subsequently acquired installations,facilities, and operations of the Employer, wherever New PositionsAEach newly created position shall be assigned by the Employerto the National craft unit most appropriate for such position with-in thirty (30) days after its creation.

8 Before such assignment ofeach new position the Employer shall consult with the Union forthe purpose of assigning the new position to the National craftunit most appropriate for such position. The following criteriashall be used in making this determination:A1 existing work assignment practices;A2 manpower costs;A3 avoidance of duplication of effort and make work assign-ments;A4 effective utilization of manpower, including the postal Ser-vice s need to assign employees across craft lines on a tem-porary basis;A5 the integral nature of all duties which comprise a normalduty assignment;A6 the contractual and legal obligations and requirements ofthe Union shall be notified promptly by the Employer regardingassignments made under this provision. Should the Union dis-pute the assignment of the new position within thirty (30) the date the Union has received notification of the assign-ment of the position, the dispute shall be subject to the provisionsof the grievance and arbitration procedure provided for Performance of Bargaining Unit WorkASupervisors are prohibited from performing bargaining unitwork at post offices with 100 or more bargaining unit employees,except:A1 in an emergency which is defined to mean an unforeseencircumstance or a combination of circumstances whichcalls for immediate action in a situation which is not ex-pected to be of a recurring nature;A2 for the purpose of training or instruction of employees;A3 to assure the proper operation of equipment;A4 to protect the safety of employees.

9 OrA5 to protect the property of the offices with less than 100 bargaining unit employees, supervi-sors are prohibited from performing bargaining unit work exceptas enumerated in Section through above or whenthe duties are included in the supervisor s position description.[See Memo, page 117]ARTICLE 2 NON-DISCRIMINATION AND CIVIL RIGHTSS ection Statement of PrinciplesThe Employer and the Union agree that there shall be no discriminationby the Employer or the Union against employees because of race, color,creed, religion, National origin, sex, age, or marital status. In addition,consistent with the other provisions of this Agreement , there shall be nounlawful discrimination against employees, as prohibited by the Reha-bilitation Act of 1973 or the Vietnam Era Veterans Readjustment Act of1974.[See Memo, page 117]Section CommitteeNon-Discrimination and Civil Rights are proper subjects for discussionat Labor-Management Committee meetings at the National , regional/area and local levels provided in Article GrievancesGrievances arising under this Article may be filed at Step 2 of the griev-ance procedure within fourteen (14)

10 Days of when the employee or theUnion has first learned or may reasonably have been expected to havelearned of the alleged discrimination, unless filed directly at the nationallevel, in which case the provisions of this Agreement for initiating griev-ances at that level shall Dual FilingThe Union, at the National and local levels, will take affirmative steps toensure that bargaining-unit employees are informed that they should notpursue essentially contractual matters simultaneously under the griev-ance and EEO Union, at the National and local levels, will not encourage dual filingof 3 MANAGEMENT RIGHTSThe Employer shall have the exclusive right, subject to the provisions ofthis Agreement and consistent with applicable laws and direct employees of the Employer in the performance of offi-cial duties; hire, promote, transfer, assign, and retain employees in posi-tions within the postal Service and to suspend, demote, dis-charge, or take other disciplinary action against such employees; maintain the efficiency of the operations entrusted to it; determine the methods, means, and personnel by which suchoperations are to be conducted; prescribe a uniform dress to be worn by designated em-ployees.
