2 Specifically,this regulation applies to (a) Active Army, Army National Guard/A r m y N a t i o n a l G u a r d o f t h e U n i t e dStates, and United States Army Reserve.(b) Tenants, contractors, and lessees per-forming functions on real property underj u r i s d i c t i o n o f t h e D e p a r t m e n t o f t h eArmy (for example, Army and Air ForceE x c h a n g e S e r v i c e ( A A F E S ) , D e f e n s eCommissary Agency (DECA)).( c ) A c t i v i t i e s a n d o p e r a t i o n s u n d e r t h ep u r v i e w o f t h e A r m y e v e n w h e n p e r -formed off of installations.(d) Formerly used defense sites (FUDS)and other excess properties managed bythe Army.

4 All Armyo r g a n i z a t i o n s , r e g a r d l e s s o f t h e i r o r -ganizational level or chain of command,have Environmental responsibilities as partof their functions; these Environmental re-s p o n s i b i l i t i e s m u s t b e i n c o r p o r a t e d i n t ot h e p l a n n i n g , p r o g r a m m i n g , b u d g e t i n g ,and execution of their respective Assistant Chief of Staff for Installa-t i o n M a n a g e m e n t , w o r k i n g t h r o u g h t h eDirector of Environmental Programs (seeResponsibilities, para 1 13x), has specificand more narrowly defined responsibili-ties that are planned, programmed, budg-eted, and executed via assigned accounts resource specifically pre-scribed and focused Environmental organization must program and fundits Environmental activities from the ap-propriate account of the proponent s oper-a t i n g b u d g e t , n o t n e c e s s a r i l y a nenvironmental account.

5 Being mindful ofthe context in which requirements are ar-ticulated will help define the scope of the"program" being addressed and will pre-c l u d e i n a p p r o p r i a t e r e s o u r c i n g d e c i s i o n sor and exception proponent of this regulation is theAssistant Chief of Staff for InstallationManagement. The proponent has the au-thority to approve exceptions or waiversto this regulation that are consistent withlaw and regulations. The proponent maydelegate this approval authority, in writ-ing, to a division chief within the propo-nent agency or its direct reporting unit orfield operating agency, in the grade ofcolonel or the civilian equivalent.

6 Activi-ties may request a waiver to this regula-t i o n b y p r o v i d i n g j u s t i f i c a t i o n t h a tincludes a full analysis of the expectedbenefits and must include formal reviewby the activity s senior legal officer. Allwaiver requests will be endorsed by thecommander or senior leader of the requ-e s t i n g a c t i v i t y a n d f o r w a r d e d t h r o u g ht h e i r h i g h e r h e a d q u a r t e r s t o t h e p o l i c yproponent. Refer to AR 25 30 for management control regulation contains management con-trol provisions and identifies key manage-ment controls that must be u p p l e m e n t a t i o n .
