1 EXELON GENERATION COMPANY, LLC, GENERATING FACILITIES AMENDMENT TO THE general PRESIDENTS project maintenance agreement april 14, 2005 This Amendment (to be known as EXELON GENERATING Amendment ) to the general Presidents project maintenance agreement (hereinafter referred to as GPPMA ), is in effect for those contractors executing a Letter of Assent ( LOA ) approved by the general Presidents Committee on Contract maintenance for the performance of maintenance and/or modification work at power GENERATING facilities of EXELON GENERATION Company, LLC, (hereinafter referred to as Owner ). The International Unions signatory to the EXELON GENERATING Amendment on their own behalf and on behalf of all of their affiliates, including their respective Local Union s acknowledge and agree that, 1) this Amendment supercedes any existing agreement covering work which is covered by the Amendment to which Amendment said International Unions, and/or their affiliates (including their Local Unions) and Contractors signing an LOA are parties; and 2) said existing agreement shall be terminated with respect to such Contractors as of the effective date of approval by The general Presidents Committee on Contract maintenance of an LOA executed by said Contractor.

2 The Contractors and Unions who are Parties to this Amendment acknowledge and subscribe to the Covenants set forth in the GPPMA. The Parties also recognize that the maintenance and modification work performed at the Owner s GENERATING facilities is critical to the continued supply of affordable electrical power within the Owner s GENERATING system throughout the United States. To accomplish the goals of performing maintenance and modification work with the highest regard for safety, quality, cost effectiveness and timeliness requires that the Parties exhibit a positive attitude intent on success. CH1 3133251v1 2 Therefore, the Contractors and Unions subject to the EXELON GENERATING Amendment dedicate themselves to the goal that together, in full cooperation, labor and management will perform the work covered by this Amendment in a safe environment, with excellent quality, as economically as possible, under favorable working conditions.

3 Each Union agrees that the Amendment does not have the effect of creating any joint employer status for the Owner.
