2 To provide for the rights ofpersons regarding unsolicited electronic communications and automated decisionmaking; to regulate the flow of personal information across the borders of theRepublic; and to provide for matters connected THAT section 14 of the Constitution of the Republic of South Africa, 1996, provides thateveryone has the right to privacy; the right to privacy includes a right to protection against the unlawful collection,retention, dissemination and use of personal information; the State must respect, protect, promote and fulfil the rights in the Bill of Rights;AND BEARING IN MIND THAT consonant with the constitutional values of democracy and openness, the need foreconomic and social progress, within the framework of the information society,requires the removal of unnecessary impediments to the free flow of information,including personal information;AND IN ORDER TO regulate, in harmony with international standards, the processing of personalinformation by public and private bodies in a manner that gives effect to the rightto privacy subject to justifiable limitations that are aimed at protecting other rightsand important interests,(English text signed by the President)(Assented to 19 November 2013 )3No.

3 37067 Government Gazette , 26 November 2013 Wet No. 4 van 2013 Wet op Beskerming van Persoonlike Inligting, 2013 ALGEMENE VERDUIDELIKENDE NOTA:[]Woorde in vet druk tussen vierkantige hake dui skrappings uitbestaande verordeninge met n volstreep daaronder, dui invoegings inbestaande verordeninge bevordering van die beskerming van persoonlike inligting wat deur openbareen privaatliggame geprosesseer word; om sekere voorwaardes daar te stel ten eindeminimum vereistes vir die prosessering van persoonlike inligting te vestig; omvoorsiening te maak vir die instelling van n Inligtingsreguleerder om sekerebevoegdhede uit te oefen en om sekere pligte en werksaamhede ingevolge hierdieWet en die Wet op Bevordering van Toegang tot Inligting, 2000, te verrig.

4 Omvoorsiening te maak vir die uitreiking van gedragskodes; om voorsiening te maakvir die regte van persone met betrekking tot ongeoorloofde elektroniesekommunikasie en geoutomatiseerde besluitneming; om die vloei van persoonlikeinligting oor die grense van die Republiek te reguleer; en om voorsiening te maakvir aangeleenthede wat daarmee in verband ERKENNING DAT artikel 14 van die Grondwet van die Republiek van Suid-Afrika, 1996, voorsieningmaak dat elke persoon die reg op privaatheid het; die reg op privaatheid ook n reg op beskerming teen die onregmatige insameling,behoud, verspreiding en gebruik van persoonlike inligting behels; die Staat die regte in die Handves van Regte moet eerbiedig, beskerm, bevorder enverwesenlik;EN GEDAGTIG DAARAAN DAT in ooreenstemming met die grondwetlike waardes van demokrasie en openheid, dienoodsaaklikheid vir ekonomiese en sosiale vooruitgang, binne die raamwerk vandie inligtingsamelewing, vereis dat onnodige struikelblokke ten opsigte van dievrye vloei van inligting, met inbegrip van persoonlike inligting, verwyder word;EN TEN EINDE die prosessering van persoonlike inligting deur openbare en privaatliggame tereguleer, in harmonie met internasionale standaarde, op n wyse wat gevolg gee aandie reg op privaatheid onderhewig aan regverdigbare beperkings wat daarop gemikis om ander regte en belangrike belange te beskerm,(Engelse teks deur die President geteken)(Assented to 19 November 2013 )4No.
