Agency/Organization meanstheUnitedStatesfederalagency,bureau ,division, I , me , my and mine refertotheAgency/Organizationemployeenam edontheCardandwhohasagreedtobeboundbythi sAgreement.(1)THIS AGREEMENTB yactivating,signingorusingtheCardortheac countestablishedinconnectionwithit( Account ),I I donotagreetothetermsofthisAgreement,I agreethatI willbeboundtothetermsofthisAgreementtoth eextentthatI usetheCard.

2 (2)USE OF THE CARDC hargingandcashadvanceprivileges(ifallowe d) agreetousetheCardonlyforofficialtravelan dofficialtravelrelatedexpensesawayfrommy officialstation/ agreenottousetheCardforpersonal, understandthattheCardisnottransferablean dwillbeusedbymealoneonlyafterI havesignedtheCardonthebackabovethewords authorizedsignature. Unlesscanceled, ,I amrequestingthattheBankissuea :(i) ;(ii)uponterminationofmyemploymentwithmy Agency/Organization;(iii)upontermination oftheGSAC ontractand/ortaskorderbetweentheBankandt heAgency/Organization;(iv)if thecardisrepor tedlostorstolen;or(v)asnotedinSection10o fthisAgreement.(3)LOSS, THEFT OR UNAUTHORIZEDUSEI agreetonotifytheBankandmyAgency/Organiza tionimmediatelyofanyloss, willnotifytheBank,byphoneat1-800-790-720 6,tollfreeintheContinentalUnitedStates,H awaii,Alaska,VirginIslands,Puer toRico,orCanada, willnotifymyAgency/Organizationif myCardisreturnedtomeafterIhavenotifiedth eBank,I willnotbeliableforunauthorizedchargestha taremadeonmyCard.

3 (4)PAYMENTTheBankwillprovidememonthlywit ha billingstatement,whichsetsfor thbillingdatawithrespecttoallmycharges, ,infull, tainchargesmaybebilleddirectlytomyAgency /Organizationandwillappearonmybillingsta tementasa ,I ,inelectronicformorwitha ,orwitha draftora checkdrawnona theBankdecidestoacceptapaymentmadeinsome otherform,paymentwillnotbecreditedtomyAc countuntilmypaymentisconver ,par tialpaymentsorchecksandmoneyordersmarked paymentinfull orwithotherrestrictiveendorsementswithou tlosinganyrightsunderthisAgreementorunde rthelaw.(5)CHARGESMADE IN Foreign CurrencyConversionProcedures:IfI makea transactionina foreigncurrency,otherthana cashadvancemadeata branchorATMofoneoftheBank sCitiaffiliates,MasterCardorVisa,dependi ngonwhichcardisused,willconver rateit selectsfromtherangeofratesavailableinwho lesalecurrencymarkets,whichmayvaryfromth erateitreceives, a cashadvanceismadeinaforeigncurrencyata branchorATMofoneoftheBank saffiliates,theamountwillbeconver sCitiaffiliatecurrentlyusesa for TransactionsMade in ForeignCurrencies.

4 Foreachpurchasemadeina foreigncurrency, ,if applicable, (i)addedto,andintegratedwith,theapplicab lecurrencyconversionrateor(ii)addedto,an dintegratedwith,thepostedtransactionamou nt.(6)DISHONOREDCHECKSIf anymoneyorder,checkordraftisdeliveredtot heBankandcannotbeprocessed,orisnothonore dforitsfaceamountwhenpresented,Iagreetha ttheBankmayimposeasliquidateddamagesfori tscostsachargeof$15.(7)BILLINGINQUIRIES/ PROBLEMSWITH GOODS AND SERVICESIf I haveanyquestion,problemordisputeaboutthe billingstatement,IwillnotifytheBankinwri tingorbytelephone, understandthatI cannotholdtheBankaccountable,andtheBanki snotresponsible,forproblemssuchasmalfunc tions,failuresduetolackofquality,orother defectsrelatingtothegoodsorservicesthatI , anyestablishmentrefusestohonortheCard,or foranyotherproblemI mayhavewithsuchestablishment.

8 (11)CHANGINGTHIS AGREEMENTTheBankmay,uponwrittenapprovalb ytheGSAandmyAgency/Organization, I donotagreetothechanges,I agreethatI willbeboundbythenewtermsif I usetheCardaftertheeffectivedateofthenewt erms.(12)LIABILITYFOR CHARGESI amresponsibleforallpurchases,cashadvance sandfeeschargedtotheCardissuedtome,andth eBankwillseekpaymentforallchargesdirectl yfrommeregardlessofwhetherI havebeenreimbursedbymyAgency/Organizatio n.(13)DISCLOSUREOF INFORMATIONI nadditiontoroutineusesunderthePrivacyAct ,I authorizetheBankto:(i)provideinformation aboutmyAccounttotheBank sserviceprovidersadministeringmyAccountu ndertheGSAC ontract;and(ii)discloseallnecessaryAccou ntinformationtooutsideattorneys,collecti onagenciesorcreditrepor tingagencies,if theBankrefersallorpar tofmyAccountforcollectioninaccordancewit htheGSAC ontractandmyAgency/Organization understandthatpastdueAccountswillberepor ,I amprovidingmywrittenconsenttothedisclosu reofinformationasprovidedinthisSection13 .

(16)GOVERNINGLAWThisAgreementandmyAccoun taresubjecttotheGSAC ontractandshallbegovernedbySouthDakotala wandthelawsoftheUnitedStates.(17)ARBITRA TIONPLEASEREAD THIS PROVISIONOF THE ANY DISPUTEMAY BE RESOLVEDBY RIGHT TO GO TOCOURT, INCLUDINGTHE RIGHT TO A JURY TRIAL AND THE RIGHTTO PARTICIPATEIN A CLASS ACTIONOR ,A DISPUTEIS RESOLVEDBY AN ARBITRATORINSTEADOF A JUDGE OR JURY. 10 ClaimsCovered What Claims are subject to arbitration?AllClaimsrelatingtomyAccount ,a priorrelatedaccount,ortherelationshipbet weenmeandtheBankaresubjecttoarbitration, includingClaimsregardingtheapplication,e nforceability, ,nomatterwhatlegaltheorytheyarebasedonor whatremedy(damages,orinjunctiveordeclara toryrelief) ,tor t(includingintentionaltor t),fraud,agency,myortheBank snegligence,statutoryorregulatoryprovisi ons,oranyothersourcesoflaw;Claimsmadeasc ounterclaims,cross-claims,third-par tyclaims,interpleadersorotherwise; par tywhoinitiatesa proceedingincour tmayelectarbitrationwithrespecttoanyClai madvancedinthatproceedingbyanyotherpar tofa classaction,privateattorneygeneralorothe rrepresentativeactionaresubjecttoarbitra tiononanindividual(non-class,non-represe ntative)basis,andthearbitratormayawardre liefonlyonanindividual(non-class,non-rep resentative)basis.
