Message from the Minister February 2017. This revised health , Safety and Reclamation code for Mines in British columbia 2017. ( code ) reflects the culmination of almost two years of work undertaken by a code Review Committee and its two technical sub-committees on tailings storage facilities and health and Safety . The committees consisted of representation from industry, labour and, for the first time in this code 's history, First Nations. The code Review Committee was chaired by the Chief Inspector of Mines.

3 The failure of the tailings storage facility (TSF) at Mount Polley mine was a wakeup call, and not just for British columbia but for the mining industry and governments throughout Canada and around the world. Our government is leading Canada in making changes to how mining is done, and we will continue to work hard to ensure our mining policies are the best in the world. Through these updates to the code along with other actions already taken, we have fully addressed the seven recommendations from the Independent Expert Engineering Panel's investigation into the Aug. 4, 2014, tailings pond breach at the Mount Polley Mine. British Columbians can have confidence that our standards for tailings storage facilities are as good as exists anywhere in the world.

4 The updated code also includes revisions that address recommendations from the Chief Inspector of Mines investigation into the Mt. Polley breach and strengthen health and Safety requirements in the code . The code is used as the primary vehicle for regulation of the Province's mining industry. It includes regulatory standards that address all stages of a mine's life; from exploration through to mine development, and includes mine closure and Reclamation . I would like to thank the code Review Committees for the work they have completed on tailings management and worker Safety . Their contribution has provided a high standard for the Safety of workers and the public, as well as for the protection and Reclamation of the environment.

9 Agent means a person having control of a mine on behalf of the owner;. authorized person means a qualified person appointed or designated by the manager to perform specified duties;. chief inspector means the Chief Inspector of Mines appointed by the minister and includes a person designated by the chief inspector to act on behalf of the chief inspector;. closed mine means a mine at which all mining activities have ceased but in respect of which the owner, agent, manager or permittee remains responsible for compliance with this Act, the regulations, the code and that person's obligations under the permit for that mine;. code means the health , Safety and Reclamation code established under this Act.

10 Cultural heritage resource means a cultural heritage resource as defined in the Mineral Tenure Act;. detrimental environmental impact occurs when the quality of air, land or water substantially reduces the usefulness of the environment or its capacity to support life;. inspector means a person appointed by the chief inspector as an inspector of mines;. local union means a union certified under the Labour Relations code as the bargaining agent for employees or a unit of employees at a mine;. management means employees of a mine who act as supervisors;. management co-chair means the co-chair chosen for the occupational health and Safety committee by the manager;. 2. 1996 Mines RS Chap.
