2 8974( 8974), entitled An Act to Facilitate the Acquisition of Right-of-Way Site orLocation for National Government Infrastructure Projects and for Other Purposes, and other applicable laws; andb)Private sector infrastructure or development projects and other procurementcovered by REPUBLIC Act No. 7718 ( 7718), entitled An Act Authorizing theFinancing, Construction, Operation and Maintenance of Infrastructure Projects bythe Private Sector, and for Other Purposes, as amended: Provided, however,That for the portions financed by the Government, the provisions of this IRR-Ashall IRR-B for foreign-funded procurement activities shall be the subject of a of PolicyThe provisions of this IRR-A are in line with the Government s commitment to goodgovernance and its effort to adhere to the principle of transparency, accountability, equity,efficiency, and economy in its procurement process.

3 It is the policy of the Government thatprocurement of infrastructure projects, goods and consulting services shall be competitiveand transparent, and therefore shall be through public bidding, except as otherwise providedin this IRR-A. It is also the policy of the Government to adopt a standard and uniform set ofrules and REGULATIONS governing the procurement of infrastructure projects, goods andconsulting services for government projects and other related activities that embodies astreamlined procurement Principles on Government ProcurementGovernment procurement shall be governed by these principles:a) Transparency in the procurement process and in the implementation ofprocurement contracts through wide dissemination of bid opportunities and participationof pertinent non-government ) Competitiveness by extending equal opportunity to enable private contractingparties who are eligible and qualified to participate in public RULES and REGULATIONS of REPUBLIC Act No.

4 91842c) Streamlined procurement process that will uniformly apply to all governmentprocurement. The procurement process shall be simple and made adaptable toadvances in modern technology in order to ensure an effective and efficient ) System of accountability where both the public officials directly or indirectlyinvolved in the procurement process as well as in the implementation of procurementcontracts and the private parties that deal with government are, when warranted bycircumstances, investigated and held liable for their actions relative ) Public monitoring of the procurement process and the implementation of awardedcontracts with the end in view of guaranteeing that these contracts are awarded pursuantto the provisions of the Act and this IRR-A, and that all these contracts are performedstrictly according to and Application of IRR-A shall govern and apply to the procurement of: a) infrastructureprojects; b) goods.

5 And c) consulting services, by any branch, agency,department, bureau, office, or instrumentality of the Government, includinggovernment-owned and/or -controlled corporations (GOCCs), governmentfinancial institutions (GFIs), state universities and colleges (SUCs), and localgovernment units (LGUs). IRR-A shall apply to the procurement of infrastructure projects, goods, andconsulting services by any procuring entity, subject to the provisions ofCommonwealth Act No. 138, otherwise known as the Flag Law. Any treaty orinternational or executive agreement affecting the subject matter of this Act towhich the Philippine Government is a signatory shall be of TermsFor purposes of this IRR-A, the following terms or words and phrases shall mean or beunderstood as follows:a)Act.

6 Refers to REPUBLIC Act No. 9184, entitled An Act Providing for theModernization, Standardization and Regulation of the Procurement Activities of theGovernment and for other Purposes, otherwise known as the GovernmentProcurement Reform )Approved Budget for the Contract. Refers to the budget for the contract dulyapproved by the head of the procuring entity, as provided for in the GeneralAppropriations Act (GAA) and/or continuing appropriations , in the case of nationalgovernment agencies (NGAs); the corporate budget for the contract approved bythe governing board, pursuant to Executive Order No. 518, series of 1979 ( ), in the case of GOCCs and GFIs, and REPUBLIC Act No.

7 8292 in the case ofSUCs; and the budget approved by the Sanggunian in the case of LGUs. Forpurposes of, and throughout, this IRR-A, the terms ABC, Approved Budget forthe Contract and Approved Budget shall have the same meaning and shall beused )BAC. Refers to the Bids and Awards Committee established in accordance withRule V of this )Bid. Refers to a signed offer or proposal to undertake a contract submitted by abidder in response to and in consonance with the requirements of the biddingdocuments. For purposes of, and throughout, this IRR-A, the term Bid shall beImplementing RULES and REGULATIONS of REPUBLIC Act No.

8 91843equivalent to and be used interchangeably with Proposal and Tender, particularly when referring to the procurement of consulting )Bidder. Refers to an eligible contractor, manufacturer, supplier, distributor and/orconsultant competing for the award of a contract in any government contractor, manufacturer, supplier, distributor or consultant is said to be eligible ifit meets all the eligibility requirements issued by the procuring ) Bidding Documents. Refer to the documents issued by the procuring entity asthe bases for bids, furnishing all information necessary for a prospective bidder toprepare a bid for the infrastructure projects, goods and/or consulting servicesrequired by the procuring ) Common-Use Supplies.

9 Refer to those goods, materials and equipment that arerepetitively used in the day-to-day operations of procuring entities in theperformance of their functions. For the purpose of this IRR-A, common-usesupplies shall be those included in the Price List of the Procurement Service (PS)of the Department of Budget and Management (DBM).h) Competitive Bidding. Refers to a method of procurement which is open toparticipation by any interested party and which consists of the following processes:advertisement, pre-bid conference, eligibility screening of prospective bidders,receipt and opening of bids, evaluation of bids, post-qualification, and award ofcontract.

10 For purposes of, and throughout, this IRR-A the terms CompetitiveBidding and Public Bidding shall have the same meaning and shall be ) Consulting Services. Refer to services for Infrastructure Projects and other typesof projects or activities of the Government requiring adequate external technicaland professional expertise that are beyond the capability and/or capacity of theGovernment to undertake such as, but not limited to: (i) advisory and reviewservices; (ii) pre-investment or feasibility studies; (iii) design; (iv) constructionsupervision; (v) management and related services; and (vi) other technical servicesor special ) G-EPS. Refers to the Government Electronic Procurement System as provided inSection 8 of this )Goods.
