2 A ,buses,motorcyclesandpublicutilityvehicl es,a (DUID)referstotheactofoperatingamotorveh iclewhilethedriver,afterbeingsubjectedto aconfirmatorytestasmandatedunderthisAct, isfoundtobepositiveforuseofanydangerousd rug, a rapidtestperformedtoestablishpotential/p resumptivepositiveresultonthepresenceofd angerousdrugsin aperson' (GCMS)tovalidateandconfirmtheresultofa DrugScreeningTest, (DRE)refersto aLawEnforcementOfficer(LEO)trainedanddep utizedbytheLTO (DRP)refersto astandardizedandsystematicmethodofdeterm iningwhetherapersonis drivingundertheinfluenceofdangerousdrugs andothersimilarsubstances, initiallyassessanddetermineintoxication, namely:theeyetest(horizontalgazenystagmu s), ("horizontalgazenystagmus")referstohoriz ontalorlateraljerkingofthedriver'seyesas heorshegazessidewaysfollowing a movingobjectsuchasapenorthetip of a penlight held bytheLEO from adistanceofaboutone(1) astraightline for nine (9)steps,turnattheendandreturntothepoint of or left leg with isImplementingRulesandRegulations| RA10586instructedto keep thefootraised about six(6)inches off thegroundfor thirty (30) lawenforcementofficersoftheLTO orauthorizedofficertrained and deputized by to anylandtransportationvehiclepropelledbya nypowerotherthanmuscularpower, and buses aremotorvehicleswithgrossvehicleweightfr om 4501 kgandabove, two (2) or three (3)

3 Wheeledmotor carry or transport 'sEducationEveryapplicantofa motorvehicledriver'slicenseshallcomplete acourseofinstructionthatprovidesinformat iononsafedrivingincluding,but not limited to,theeffectsoftheconsumptionofalcoholic beveragesontheabilityofapersontooperatea motorvehicle,thehazardsofdrivingunderthe influenceofalcohol,dangerousdrugsand/oro thersimilarsubstances, 'seducationshallincludemodulesoneffectsa ndhazardsofconsumptionofalcoholanddrugst o driving, ' ,everyapplicantfor adriver'slicenseorthoseapplyingforrenewa lthereofshallundergothedriver' allapplicantsofdriver'slicense,whetherne worrenewal,shallbeimplementeduniformlyna tionwideandshallincludetheimpactof alcohol,drugs,fatigueanddistracteddrivin g on adriver' 'slicensewrittenexaminationshallincludeq uestionsconcerningtheeffectsof alcoholanddrug intoxication ontheabilityof apersontooperatea motorvehicleandthelegalandpecuniaryconse quencesresultingfrom violation thispurpose,theLTO shallcausetherevision of the motor vehicle isundertheinfluence ofalcohol,dangerousdrugsand/orothersimil arsubstancesuponpersonallywitnessing atrafficoffense committed bymeansof lane straddling, makingsuddenstops,overspeeding,swervingo rweavinginsuchanapparentImplementingRule sandRegulations| RA10586wayastoindicatethatthedriverisund ertheinfluenceofalcohol, ,theevidentsmell of alcohol in adriver'sbreath,generallyslurredspeechin responsetoquestioning,bloodshotorreddish eyes,flushedface,poorcoordination,diffic ultyinunderstandingandrespondingintellig ently ,theburdenof proof ,adeputizedLEOshallflagdownthemotorvehic le.

4 TheLEOshallexpresslyinformthedriverofhis assessmentandthedrivershallbedirectedtop erformallofthethree(3) 'sresponsestothefieldsobrietytestsabovee numerated, ofthethree(3) fieldsobrietytests, ,theLEO shallproceedtodeterminethedriver'sBAClev el,throughtheuseoftheABA, 'slicense,inadditiontootherpenaltiesprov idedhereinand/orotherpertinentlaw, ,afterABAtesting,registersa claimedbyanauthorizedrepresentativeof BACwithintheallowedlimit, ,whohasundergoneandpassedthefieldsobriet ytestand/orABAtest,besubjectedto | shallaccomplishthefollowingpreparatoryto theturnoverofthecasetothepoliceofficer-o n- complaint/chargesheet; ; ofitemsundertemporarycustody(toincludemo torvehiclewhennecessary); ,adeputizedLEOshallflagdownthemotorvehic le, , ,thedrivershallbesubjectedtoadrugscreeni ngtest,inaccordancewithexistingoperation alrulesandprocedures,andifpositive, ,whohasundergoneandpassedthedrug, ,theLEOshallaccomplishthefollowingprepar atorytotheturnoverofthecasetothepoliceof ficer-on- ; ofitemsundertemporarycustody(toincludemo torvehiclewhennecessary).

5 , 'sLicenseCustodyAlldriver'slicensesconfi scatedundertheserulesshallbeturnedoverto LTOforsafekeepingandshall bereleasedby LTO avehicularaccidentresulting in the loss of humanlifeor physical injuries shall besubjected to on sitefieldsobrietytestandABAtesting,Imple mentingRulesandRegulations| RA105866wheneverpracticable, and,thereafterchemicaltests,includinga drug screening test and, if necessary, a drugconfirmatorytestasmandated under Republic ,todeterminethepresenceand/orconcentrati onof alcohol, use other alcohol testingequipment,suchasGasChromatography -MassSpectroscopy(GCMS),whenevertheuseof an ABA is notpracticableunderprevailingcircumstanc es, driver of a motor vehicle whorefusesto undergo themandatorytestingasrequired shall bepenalizedbytheconfiscationandautomatic revocationofhisorherdriver'slicense, in addition terminalinspectionsand quickrandomdrugtestsof amotorvehiclewhorefusestoundergoquick random drugtestsasrequired shallbepenalizedbytheconfiscationandauto maticrevocationof hisorherdriver'slicense,in addition tootherpenaltiesprovided -TESTINGEQUIPMENTW ithin four (4)monthsfromtheeffectivity of this Act,theLTOandthePhilippine NationalPolice(PNP) shallacquiresufficient ABAs, drug-testingkitsandotherdrugconfirmatory equipmentandotheraccessorydevicestobedep loyedtoandutilized by LEOsnationwidegiving ,theLTOshallutilizetheSpecialRoadSafetyF undallottedforthispurposeasprovidedunder Section7 ofRepublicAct ,entitled.

6 "An ActImposinga MotorVehicleUser'sChargeonOwnersofAllTyp esof MotorVehiclesandforOtherPurposes".Additi onalyearlyappropriationsforthepurchaseof ABAs, ABAsanddrugtestingkits dulyregisteredwiththeFoodandDrugsAdminis tration(FDA) ofdataandtestresults,onlyABAsanddrugtest ingkitsthatcomplywiththestandardsprescri bedbytheDOH -EDUCATION, | RA10586yJWi-TheLTOmaydeputizeonlyactivem embersofthePNP,theMetropolitanManilaDeve lopmentAuthority(MMDA)andLGUs,whoareoccu pyingpermanentpositionitemsandwhoseprese ntworkassignmentsaredirectlyandactuallyr elatedto ,byvirtueoftheirfunctions, , beobservedby LEOs ,priortodeputation, ; ; ; "x2 Bphotosonwhitebackgroundtakenwithinthepa stsix (6)monthsandsignedattheback; drugtestresultstakenwithinthepastsix(6)m onthsprior LEOwhohascompliedwiththeabove- :thisAct, ,RepublicAct ; toconductfieldsobrietytests,ABAtest,drug screeningtestandDRP; 'sperformance; 'sarrestandinquestproceedings; for public officerssuchasRepublic ,RepublicAct , ,andotherapplicablerules.

7 | ofdeputizedLEOsandotherrecordssuchasinfo rmationsheetofdeputies,deputationorders, ID's, of deputation order. Any of thefollowingcausesshallconstitutesuffici entgroundfortherevocationofthedeputation :Discourteousconduct; ; ; ; ; authority; ; ; to submitapprehensionreport within 24hoursfromdateandtimeofapprehension; moralturpitude; ; ; ; ofendorsementbyHeadofAgencywhoendorsedth erequestfordeputation; ; while intheperformanceof duty; oraccepting,directlyorindirectlyanygift, gratuity,favour,entertainment,loanoranyt hingofmonetaryvaluefromanypersoninthecou rseofhisorherofficialdutiesorinconnectio nwithanyoperationbeingregulatedby,oranyt ransactionwhichmaybeaffectedbythefunctio nsof "CodeofConductandEthicalStandardsforPubl icOfficials"andEmployees,RepublicAct "Anti-GraftandCorruptPracticesAct",Repub licAct "Anti-RedTapeAct" verifiedcomplaintmaybefiled ofthecomplaint, | Show Cause Ordershallbe issued against thedeputizedLEOto answer the charges fileananswerwithinthetimeprescribed shall not preclude theLTOfromissuing revocation of the deputation order, theLEOshallsurrenderhis/herdeputationID, TOP booklet, revokeany deputation order at any time for A LEOwhosedeputationisrevoked.

8 Cancelledor is no longerrenewedforanyreasonwhatsoeverandwh ofails tosurrenderanyoftheaccountabilitiesherei naboveenumeratedshall bedisqualifiedfrom ofdeputationorder. Adeputationordershallbevalidfor six (6)monthsfromdateofissueandmayberenewede verysix(6) four (4)monthsfromtheeffectivity ofthisAct,theLTOshallpublishtheguideline sandproceduresfortheproperconductoffield sobrietytests,whichguidelinesshallbemade availabletothepublicandmadeavailableford ownloadthroughtheofficial driverfound tohavebeendriving amotorvehiclewhileundertheinfluenceofalc ohol,dangerousdrugsand/orothersimilarsub stances,asprovided forunderSection5 of RA10586,shall did not result in physical injuries or homicide,thepenalty ofthree(3)monthsimprisonment,anda fine ranging fromTwentythousandpesos(Php20, )to Eightythousandpesos(Php80, )shallbeimposed; the violation resulted in physicalinjuries,thepenalty provided inArticle 263 oftheRevisedPenalCodeorthepenaltyprovide dinthenext preceding subparagraph, whichever is higher, and a fineranging from One hundredthousandpesos(Php 100, ) toTwohundredthousandpesos(Php200, )shallbeimposed; homicide,thepenaltyprovidedin Article249oftheRevisedPenalCodeanda finerangingfromThreehundredthousandpesos (Php 300, ) to Five hundredthousandpesos(Php500, )shall beimposed.

9 AndImplementingRulesandRegulations| 'slicenseof anypersonfoundto haveviolatedthelawshallalso beconfiscatedand suspendedforaperiodoftwelve(12)monthsfor thefirstconvictionandperpetuallyrevoked for the 's licenseshall also beconfiscatedandperpetuallyrevoked for adriver'slicenseshalldisqualifythe personfrombeing granted anykindof driver's of this Actshallbewithoutprejudiceto criminalprosecutionfor violation oftheRevisedPenalCode,Republic and other special laws and existing localordinances, bytheoffendershallbedirectlyandprincipal ly held liabletogetherwiththeoffenderforthefinea ndtheawardagainsttheoffenderfor civildamagesunlesshe/sheisabletoconvinci nglyprovethathe/ principallyapplytotheownersand/oroperato rsofpublicutilityvehiclesandcommercialve hiclessuchasdeliveryvans,cargotrucks,con tainertrucks,schoolandcompanybuses,hotel transports,carsorvansforrent,taxicabs, ,afterfive (5)yearsfromtheeffectivity ofthisActandeveryfive (5)yearsthereafter,reviewtheapplicabilit yandenforcementofallforegoingpecuniarype naltiesandshall initiateamendmentand/orupgradethesameasm aybenecessary, (1) month fromthepromulgation of thisIRRasprovidedunderSection17 of this Act,thePhilippine InformationAgency(PIA),incoordinationwit htheLTO,theLGUsandotherconcernedagencies ,shallconductinformation,educationandcom munication(IEC) this Act, maybereconvenedby its Chairman at hisinstance,or upontheImplementingRulesandRegulations| RA10586
