1 AIR QUALITY DEQ INFORMATION Is a Vehicle Required to take DEQ's Vehicle Emissions Test? If you're not sure whether a Vehicle will be registered in the VIP boundary, you can go online to and choose the zip code where the Vehicle will be registered from the drop-down list. You can find out if the Vehicle will not be registered within the Vehicle Inspection Program Boundary. It therefore will not be Required to pass a Vehicle emissions test prior to DMV issuing new plates or renewal tags. In Medford, DEQ does not test vehicles older than 20 years, but in the Portland area they test cars and trucks back to model year 1975.

2 As of May 1, 2008, DEQ engineers in the emissions testing program state they have a new process for determining if a Vehicle is registered within DEQ's Vehicle inspection. The old method used the ZIP Codes that included any areas within the Vehicle testing boundary. The problem with that approach was that the testing boundary was different than the ZIP Code boundaries, so ZIP Codes at the edge of the testing area included vehicles that were both in and out of the controlled area. The new approach is based on street addresses and is much more accurate. It tells a person if they are in or out and does not give any more "false positive" results as the ZIP Code method could.

3 The new method begins with the same webpage, Once there, click on VIP Boundary Address Matching near the top of the page. Then enter the address where the Vehicle will be registered and click on Find Address . The computer will indicate if the Vehicle is in or out of the boundary. If the address is outside the boundary, it will display a link to Exemption From DMV Form 1400 that can be used to indicate the Vehicle is not subject to a Vehicle emissions test. The only other Air Quality requirement that might be cited is Oregon's Low Emission Vehicle (LEV).

4 As dealers should know, beginning with the 2009 model year, new vehicles must be certified to California's Vehicle emission standards. Several exemptions to this requirement are listed in Chapter 340, Division 257 of the Oregon Administrative rules which are online at: Exemptions are listed at OAR 340-257-0060 which is a little less than half way through the LEV rules. Vehicles that must be tested In the Portland area: All 1975 and newer cars, trucks, vans, motor homes and buses powered by gasoline, alternative fuels (such as propane) or hybrids registered within the DEQ Portland area boundaries All 1975 and newer diesel powered vehicles with a manufacturer's gross weight rating of 8,500 pounds or less (This includes all passenger cars and most light-duty trucks) registered within the DEQ Portland area boundaries.

5 In the Medford area: All cars, trucks, vans, motor homes and buses powered by gasoline, alternative fuels (such as propane) or hybrids 20 years old or less and registered within the DEQ Medford area boundaries All diesel powered vehicles 20 years old or less with a manufacturer's gross weight rating of 8,500 pounds or less (This includes all passenger cars and most light-duty trucks) registered within the DEQ Medford area boundaries. This includes all passenger cars and most light-duty trucks. Vehicles temporarily located outside of Oregon If your Vehicle is registered in the Oregon Vehicle Inspection boundary but temporarily located outside of Oregon AND is located more than 150 miles from the Oregon border, DEQ requires an emission test in the state you are in.

6 If there is no testing Required in your location, you will need a "Statement of Vehicle Outside of Oregon". This will allow you to register your Vehicle without an emission test until you return to Oregon, or go to an area where testing is available. Vehicles that are exempt from testing If your Vehicle is exempt you must fill out the Declaration of Exemption form and return it to DMV with your registration renewal. Heavy duty diesel-powered vehicles (gross Vehicle weight rating 8,501 or more) Vehicles legally registered outside DEQ program boundaries Motorcycles and low-speed vehicles (golf carts, tractors, all-terrain vehicles, etc.)

7 For more information about the Vehicle Inspection Program e-mail FOR DEALERS TO KNOW: 30 day rule - If a Vehicle has expired registration or will expire within 30 days of the date of sale, the dealer is 100% responsible for the Vehicle passing the emissions test. (OVDA note: Most dealers have the testing done before the sale. That way they can prove the emissions equipment is on the Vehicle at the time of sale and there are no delays in getting the Vehicle titles and registered, and perfecting the interests of any security interest holder.) Two year rule All vehicles are Required to have the proper emission equipment on them when they are sold, unless they are expressly disclaimed before the sale, and there is a monetary benefit to the customer for accepting such a disclaimer.

8 A Vehicle dealer is responsible for up to two years, or the time of the next re-registration for ensuring the proper emission equipment is on a Vehicle . Parts Car Rule If a Vehicle is sold for parts, then it can t be driven. Such a car can be sold without any emissions responsibility of the dealer, but the dealer should not allow the Vehicle to be driven off the lot. If it is driven off the lot, the disclaimer of responsibility likely won t hold up in any investigation. The disclaimer and acceptance of the disclaimer by the buyer should be clear that the Vehicle is only being sold for parts.

9 LAND USE and WATER QUALITY Each business in Oregon must comply with the land use regulations for their particular area.
