7 Regarding the claim that the decision of the council of Ministers which constitutes the subject matter of this case does not violate the law on the grounds that the properties which have become the subject of the immediate expropriation decision have been individually determined by indicating quarter, square, and parcel numbers; that the aim of the decision is to ensure healthy housing in the region with respect to the risky area declaration, and the immediate completion of the restoration works regarding the immovable cultural assets in the region in line with their original state; that the immediate expropriation decision has been taken in order to prevent the creation of a collapse area in the perimeter of the city, and to complete zoning reclamation as soon as possible.

9 Parcel is requested on the grounds that the decision of the council of Ministers is against law, immediate expropriation is an exceptional way, the decision of the council of Ministers is an abstract decision that includes all properties within the region, a cause should be presented for each real estate within the region, registration of the region as World Heritage by UNESCO is an obstacle for such a decision, and there is no need for such urgency. Summary of the Plea: It is stated that although the area which is the subject matter of the dispute has been taken under protection since 1988 with the protection decisions and the following protective zoning plans, the region still developed in an unhealthy manner; the region has been proclaimed as a risky area upon the official letter of Diyarbak r Metropolitan Municipality dated , numbered 5414 stating that.

10 Buildings within the Suri i area with more than 2 floors have fulfilled their economic life, hence, they create a risk against the lives and property of people ; that it is aimed to establish a healthy housing structure in the region with the help of necessary engineering services; the inventory of the cultural assets located at the region has been prepared; all the necessary surveys have been conducted before the risky area decision in 2012 which later became the basis for the immediate expropriation decision that is the subject matter of the case; risk maps regarding the ground and structure stock have been prepared; unregistered housing at the region is at a high level; victimization of the people following the terrorist activities in the region should immediately be compensated, and it is argued that the case should be rejected on these grounds.
