2 Settlement of matter out of Modification of protection Public 202007 Sierra LeoneThe domestic violence Act, an Act to suppress domestic violence , to provideprotection for the victims of domestic violence and to provide forother related matters. [ ]ENACTED by the President and Members of Parliament in thispresent Parliament of this 26th day of July, 2007 ALHAJI AHMAD TEJAN KABBAH, 20 domestic violence Act2007No. 20 domestic violence Act2007 PART 1 this Act, unless the context otherwise requires- abuse means conduct that harms or is likely to causeharm to the safety, health or well-being of thecomplainant; aggravated in relation to domestic violence refers toany act of domestic violence where-(a) it has caused the victim to suffer woundingor grievous bodily harm; or(b) the court otherwise considers the incident orincidents to be so serious as to be aggravated,taking into consideration-(i) whether a weapon was used.

3 (ii)any failures to respond to previouswarnings by the police, the court or anyofficial body;(iii)evidence of premeditation;(iv)whether the victim is particularlyvulnerable; and(v) any other consideration the courtconsiders appropriate; applicant means a person who applies for a protectionorder under this Act; associated respondent means a person associatedwith another person against whom an applicationfor a protection order has been brought; child means a person below eighteen years; complainant means a person who makes a complaintto the police under section 5; court means the High Court or Magistrate s Court; economic abuse means(a) the unreasonable deprivation of anyeconomic or financial resources to which thecomplainant, or a family member or dependantof the complainant is entitled under any law,requires out of necessity or has a reasonableexpectation of use, including householdnecessaries and mortage bond repaymentsor rent payments in respect of a sharedhousehold.

4 (b) unreasonably disposing of moveable orimmovable property in which the complainantor family member or dependant of thecomplainant has an interest or a reasonableexpectation of use;(c) destroying or damaging property in whichthe complainant, or a family member or adependant of the complainant has an interestor a reasonable expectation of use; emergency monetary relief means compensation formonetary losses suffered by a complainant at thetime of the issue of a protection order as a result ofthe domestic violence , including, as appropriate-(a) loss of earnings;(b) medical and dental expenses;(c) relocation and accommodation expenses; and(d) household necessaries.

5 Harassment means sexual contact without theconsent of the person with whom the contact ismade, repeatedly making unwanted sexual advances,repeatedly following, pursuing or accosting a personor making persistent, unwelcome communicationwith a person and includes -(a) watching, loitering outside or near a buildingwhere the harassed person resides, works,carries on business, studies or happens tobe; 20 domestic violence Act2007No. 20 domestic violence Act2007(b) repeatedly making telephone calls or inducinga third person to make telephone calls to theharassed person, whether or notconversation ensues;(c) repeatedly sending, delivering or causing thedelivery of letters, telegrams, packages,facsimiles, electronic mail or other objects ormessages to the harassed person s residence,school or workplace; or(d) engaging in any other menacing behaviour.

6 Household chattels include jewellery, clothes,furniture and furnishings, refrigerator, television,radiogram, other electrical and electronic appliances,kitchen and laundry equipment, simple agriculturalequipment, hunting equipment, books, motorvehicles, other than vehicles used wholly forcommercial purposes, and household livestock; interim protection order means an order made by thecourt under section 12 pending the finaldetermination of an application; intimidation means intentionally inducing fear inanother person by-(a) threatening to abuse that person or a thirdparty;(b) threatening to damage, destroy or disposeof property in which that person or a thirdparty has a material interest; or(c) exhibiting a weapon before that person; marriage includes marriage under any custom orreligion; Minister means the Minister responsible for socialwelfare and Ministry shall be construedaccordingly.

7 Next friend means a person who intervenes to assista child to bring a legal action; offender means a person against whom a complaintof domestic violence is filed; order means a protection order; physical abuse means physical assault or use ofphysical force against another person, including theforcible confinement or detention of another personand the deprivation of another person of access toadequate food, water, clothing, shelter, rest, orsubjecting another person to torture or other cruel,inhuman or degrading treatment or punishment; place of safety means premises where the welfare ofa victim of domestic violence is assured; protection order means an order made by the courtunder sections 13, 14 and 15 on the finaldetermination of an application; respondent means a person against whom aprotection order is brought.

8 Sexual abuse means the forceful engagement ofanother person in a sexual contact, whether marriedor not, which includes sexual conduct that abuses,humiliates or degrades the other person or otherwiseviolates another person s sexual integrity, whethermarried or not, or a sexual contact by a person awareof being infected with human immunodeficiency virus(HIV) or any other sexually transmitted infection withanother person without that other person beinggiven prior information of the II - OFFENCE OF domestic VIOLENCE2.(1) It is an offence under this Act for any person in adomestic relationship to engage in any act of domestic 20 domestic violence Act2007No.

9 20 domestic violence Act2007(2) For the purposes of subsection (1), domestic violencemeans any of the following acts or threat of any such act:-(a) physical or sexual abuse;(b) economic abuse;(c) emotional, verbal or psychological abuse,including any conduct that makes anotherperson feel constantly unhappy, humiliated,ridiculed, afraid or depressed or to feelinadequate or worthless;(d) harassment, including sexual harassment andintimidation;(e) conduct that in any way harms or may harmanother person, including any omission thatresults in harm and either-(i) endangers the safety, health orwellbeing of another person;(ii)undermines another person s privacy,integrity or security; or(iii)detracts or is likely to detract fromanother person s dignity or worth as ahuman being.

10 (3) An offence under subsection (1) shall be punishableby a fine not exceeding Le5,000,000 or by a term of imprisonment notexceeding 2 years or by both such fine and (1) A domestic relationship means a family relationship , arelationship akin to a family relationship or a relationship in a domesticsituation that exists or has existed between a complainant and anoffender and includes a relationship where the complainant (a) is or has been married to the offender;(b) lives with the offender in a relationship in thenature of a marriage notwithstanding thatthey are not, were not married to each otheror could not or cannot be married to eachother;(c) is engaged to the offender, courting theoffender or in an
