2 To take up the duties of a new post; orii. In consequence of a change of his headquarters.[Ref: Rule 103(51) Indian Railway Establishment Code Vol. I 1985]3. Transfer may be ordered either on a temporary basis or on a basis otherwisethan Wherever the Transfer of a Railway servant is temporary, the sameshould be mentioned in the Transfer Transfers otherwise than on temporary basis, are necessitated byadministrative requirements or occasioned by consideration of requests receivedfrom the Railway servants. 8 [Ref: Board's letter No. E(NG)II-78 TR/85 dated ] Transfers are ordered in certain cases at the instance of theVigilance Organisation/Special Police Establishment, to facilitate properenquiries being made etc. In order to ensure that there is noharassment and/or victimisation on this account, the DRM in respect ofDivisionally controlled staff and the CPO in respect of Headquarterscontrolled staff may hear representations of genuine grievance, if anymade, before a final decision is taken to effect the Transfer . Thisprocedure will not, however, apply to the cases of Transfer of officebearer(s) of the recognised Unions, who are governed by a separate setof orders.

9 [Ref: Board's letters No. E(NG)II/77/TR/112 dated ] As a measure of safeguard against possible malpractices in thetransfers, whenever the Transfer order of a Railway servant issued bythe competent authority on the basis of complaints, Vigilance/CBIenquiries etc., is proposed to be cancelled without the Railway servanthaving actually carried out the Transfer order or it is proposed to bringback the employee concerned to the original place of posting within oneyear, the competent authority should obtain the approval of the nexthigher authority, providing the full details of the case to the said higherauthority and the reasons which justify the change in the originaltransfer orders.

10 It should also be kept in view that a Railway servantundergoing penalty as a result of a vigilance case is not posted in anypost involving public dealings especially in areas prone to corruption.[Ref: Board's letter No. E(NG)I/80/TR/28 dated (RBE156/88)] Ticket checking staff, detected indulging in malpractices, should besent on inter-Divisional Transfer , as a matter of policy. They may betransferred to an adjoining Division on the same Railway. They may alsobe transferred to a Division on another Railway adjoining their parentRailway, if they make a request to that effect. The ticket checking staff,who have been so transferred out of the existing Division on complaintsof corruption and later exonerated or awarded a penalty of censureshould not be brought back to the parent Division, even if they sodesire.
