2 Of the Hon'ble Supreme Court of India in SLP. (Civil) No. 5141/2002, on the status of Hyderabad City as free zone, and subsequent orders dt. in the Contempt Application No. 382/2013 in the SLP to revise seniority of Hyderabad City and Hyderabad Range from 1972 onwards as directed by APAT in orders in 1787/2010 and batch cases, the state wide integrated seniority list of Inspectors of Police issued earlier in 361 Home ( ) Department, dt. with 6 Ranges by combining Hyderabad City in Hyderabad Range, as per the orders of High Court in 13458/2001 and batch cases, was revised with Hyderabad City as a separate City Range vide reference 1st cited by the erstwhile Government of compliance report was filed in the Contempt Petition No. 382/2013 and the same was closed by the Hon'ble Supreme Court of India. 2. Due to subsequent developments revival of the 382/2013 in the SLP for not effecting further promotions based on 1st cited, and keeping in conformity with the undertaking given to the Hon'ble Supreme Court of India that by the promotions issued earlier will be streamlined as per , dt.

3 , the seniority lists upto the ranks of SsP (NC) were finalized, notional seniority assigned and further promotions effected in each cadre separately in Andhra Pradesh and Telangana States by the respective Governments and a compliance report through an affidavit was filed in the (PTO. : 2 : Hon'ble Supreme Court of India by all the concerned on duly submitting that if any further individual representations are received in the matter they will also be considered on merits and in accordance with rules, and rectification orders will be issued. 3. However, immediately after issue of the Ms. No. 54 Home ( ) Dept., dt. 22-02- 2014, and pending closure of Contempt Application in the Hon'ble Supreme Court of India, several representations, viz., (9) from Hyderabad Range, (14) from Hyderabad City and (3) from Warangal Range signed by group of officers ranging from 2 to 15 in each representation were received pointing out certain lapses in the approved seniority list, and requested to rectify the same.)

4 The gist of the objections are as follows: 1. Vacancies were inflated in some units to confer better dates. 2. Deputation vacancies were taken into account though there is no deputation quota. 3. Vacancies arose in one Range was taken into account in another Range. 4. Variation in sanctioned strength and actual strength. 5. Vacancies taken by repeating some names twice. 5. The vacancies arose in one panel year were not carried forward to the next panel year. 6. The vacancies of Inspectors who are under , suspension, sick were taken into account in violation of service rules. 7. The substantial posts that were sanctioned were shown as vacancies without creation of Police Stations and other establishments. 8. The vacancies that arose in the panel year 1987-88 to 1990-91 in Warangal Range were not taken depriving the promotional chances of Inspectors of Warangal Range. 4. The state wide seniority list of DSsP issued in 108 Home ( ). Department, dt. , was also challenged in APAT vide 4286/14 and 4287/14.

5 For not following rota and quota system specified in the Service Rules for direct recruits. Hence, in pursuance of the orders of Hon'ble APAT in above OAs, the Government of in Memo No. 5833 , dt. has requested the DGP, Hyderabad to re-examine the entire matter with regard to fixation of seniority of the DSsP (Civil) issued in 108 Home ( ) Department, dt. duly stating that in pursuance of Hon'ble Supreme Court orders in the it has become mandatory for revision of seniority right from the category of Inspectors and requested to review the year-wise panels by taking into account the year wise cadre strength with supporting and based on the cadre strength of Inspectors of Police and higher categories and duly apportioning the vacancies of Inspectors of Police and DSsP as per Rules. 5. In addition to the representations, the Inspectors of Warangal Range and Hyderabad City have also filed OAs vide No. 1972/2015 and in APAT to revise 54, by incorporating the missing panels etc. The Hon'ble APAT in the interim orders dt.

6 In 1972/2015 filed by Inspectors of Warangal Range has instructed to consider the recommendations of the DIG W/R to incorporate the : 3 : missing panels, whereas in orders in filed by Hyderabad City Inspectors, it has been directed to review the seniority list of Inspectors of Police communicated in 54, Home ( ) Department, dt. by implementing the instructions issued in Memo No. 5833 , dt. of Government of and Memo No. 378 (P) , dt. of Government of Telangana and related proceedings issued by the DGPs of both the states. 6. While the Contempt Petition (C ) No. 382/2013 in Civil Appeal No. 5141 of 2002 is still pending in the Hon'ble Supreme Court of India, several were also filed to rectify the seniority issued in 54, dt. By citing all the , the Hon'ble Supreme Court of India, finally closed the Contempt Petition vide orders with following observations: It is apparent that some of the parties to the proceedings may not be satisfied with the revised seniority list determined for the two cadres (referred to above) and may also wish to agitate on the issue of promotion based on the revised Departmental Promotion Committee, conducted by the authorities.

7 All such members of the above two cadres, shall have the right to agitate their grievances, if any, by initiating proceedings, as may be open to them, in accordance with law. Such of the members of the above two cadres, who have initiated proceedings, as are referred to herein above, and if such proceedings have been delayed on account of the pendency of the present matter, shall inform the Courts /. Tribunals concerned about the disposal of the present applications. We hope and expect that the proceedings shall now stand revived, and will be disposed of at the earliest. All the applications are disposed of in the above terms. No. 1/2014, No. 5/2014, ../2014 and No. 6/2014 and Nos.. /2014 and Nos. 3- 13/2014 (GotooruAnantha Reddy & Others Vs. Dass, IPS & Others)on 01-12-2015, nothing further survives in the instant application and the same is disposed of as such.. 7. After closure of the Contempt Application by the Hon'ble Supreme Court of India, several more representation were also received raising objections on the seniority list, some reiterating the earlier grievances and some with additional grievances.

Therefore, as per the instructions of the Government of to review the year wise panels issued by invoking the powers vested in Rule 25 of State and Subordinate Service Rules, 1996 and as per the permission accorded by the Supreme Court of India and as per the interim orders of the Hon'ble APAT as stated above, all the grievances put forth by the individuals have been verified and it has been identified that due to certain lapses occurred in preparing the seniority list issued vide 361 and 54, rectification of the seniority list from 1972. onwards in all the Ranges is necessary. 9. Moreover, since the united was bifurcated and two states have come into existence with no change in the zonal status of Inspector of Police and confined to the : 4 : existing zones in the respective states and outside the purview of bifurcation by Kamalanathan Committee, it is now imperative that new list of state wide seniority of Inspectors of Police for the state of Telangana be prepared to finalise the inter-se- seniority of remaining higher cadre.

Hence, an elaborate exercise was undertaken to rectify the lapses in respect of vacancies of Inspectors of Police in each Range of Telangana State duly maintaining transparency and by adopting following procedure common to all Ranges: 1. Vacancies to be taken into account: 1. New sanctions 2. Deputation quota fixed by Government /Chief Office 3. Retirements 4. Deaths 5. Promotions 6. Permanent reversion not re-promoted without reinstatements subsequently 8. Permanent transfers to other Ranges 9. Accelerated promotees/notional dates assigned by Government on any occasion should be adjusted against the existing vacancies only except in r/o 43 out of 63. dates assigned in and 314 as they were assigned to the City Police against the vacancies usurped by SIs/Inspectors transferred from other Ranges as per APAT orders thrice, which were upheld by the Supreme Court twice. 10. Accelerated promotees if have advantage in normal course should be assigned revised notional date or else the date of accelerated promotion should be protected.

10 11. Unfilled vacancies should be carried forward to next panel year. 2. Deletion of earlier vacancies as per the objections raised: 1. Leave/Suspension vacancies 2. Double entries 3. Excess vacancies in addition to sanction strength/deputation quota fixed. 4. Vacancies shown as retired vacancies after promotions as DSP. 5. Vacancies without mentioning cause of vacancies etc. 6. All vacancies taken by showing deputation of personnel without reserving vacancies for incoming inspectors from deputation units, since deputation quota already taken into the strength as per the Presidential Order. 11. Therefore all the grievances of the applicants of the three Ranges of Telangana State in the representations were taken into account and the process of rectification was completed with due diligence and by following the above yardsticks and provisional zonal rectified seniority list was put to notice by displaying in the Police official website by the respective Range DIGs and , Hyderabad inviting objections from all the concerned.
