New and Revised Forms and Fact SheetsTITLING AND REGISTERING VEHICLES INTHE NAME OF A CONSTABLEPennDOT occasionally receives applications to title andregister a Vehicle in the name of a constable's office( Constable John Doe or Pennsylvania StateConstable) or in combination with the name of themunicipality where the constable's office is located ( Township Constable's Office).

3 Applications fortitle and or registration that include the word"Constable" as part of the owner/applicant name will berejected. The applicants will be notified to use theiractual or bona fide PennDOT agents must use the individual'sname when completing the application forPennsylvania certificate of title and/or registration. Theapplicant must pay all sales tax and required fees whenapplying for title and registration. The applicant is notpermitted to claim an exemption from payment of salestax or any titling or registration fees based upon theirposition as a constable.

4 Additionally, Municipal Government (MG) registrationplates should not be issued by PennDOT or anyauthorized PennDOT agents for a Vehicle owned by aconstable. MG plates are only issued to vehiclesowned by a municipality itself. In all cases, the actual or bona fide name of theindividual must be used when issuing a Pennsylvaniacertificate of title or Vehicle registration. The vehicleshall NOT be titled or registered in the name of theconstable's office. Additionally, MG registration platesshould never be issued for the Vehicle .

5 Low Speed Vehicles can be identified by examining theManufacturer s Certificate of Origin (MCO) or theout-of-state certificate of title. The MCO will list anindicator of LSV/NEV/ZEV in the series or model fieldor designate that the Vehicle complies with FederalMotor Vehicle Safety Standard (FMVSS) certificate of titles usually list Low SpeedVehicle as a brand or will list LV or LSV in the bodyfield. Low Speed Vehicles do not meet Pennsylvaniaequipment standards. This type of Vehicle is notequipped as required by the Vehicle Code and theregulations of PennDOT to be operated onPennsylvania roadways.

6 Therefore, when processingtitle applications, where the proof of ownershipdocument indicates LSV/NEV/ZEV or Low SpeedLOW SPEED Vehicle TITLE ANDREGISTRATION APPLICATION PROCEDURESV ehicle, the record should be designated as an Off-Road Vehicle (ORV). No registration plates are tobe issued to Low Speed TITLE WITH REGISTRATIONAPPLICATION PROCEDUREIf a dealer wants to register a new car loaner with aregular series registration plate, they may elect to payan alternate imposition of tax directly to the Departmentof Revenue.

7 Dealers should enter "21" in the sales taxexemption reason code block on Form MV-1,"Application for Certificate of Title" or Form MV-4ST," Vehicle Sales and Use Tax Return/Application forRegistration" when they elect the alternate imposition oftax. This will allow the dealer to be issued a regularseries registration on a Vehicle titled in the dealership' titling a Vehicle in the dealership's name for thepurpose of resale, the dealer may be exempt frompaying sales tax if exemption reason code "01" isentered in block 1A on Forms MV-1 and MV-4ST andthe appropriate dealer identification number (DIN)

8 Isentered in the space provided in Section B on FormMV-1 or in the title assignment section on the reverseside of the Pennsylvania certificate of are not permitted to claim a resale exemptionand register a Vehicle with a regular series plate. If adealership is submitting an application for title claimingan "01" exemption or an "0" exemption, and requestingregistration plates to be transferred or issued to thevehicle, the application must be rejected for sales taxbased on the Vehicle 's fair market value andappropriate registration fees.

9 A dealer may not use aregular series registration plate on a Vehicle titled in thedealership's name when tax was not paid on thevehicle. Should the dealer wish to apply their dealerplates to the Vehicle and use on a long-term basis, theywill pay a use tax directly to the Department ofRevenue on a monthly basis. NATIONAL MOTOR Vehicle TITLINGINFORMATION SYSTEM (NMVTIS) PROCESSWHEN TITLING A Vehicle USING THEON-LINE REGISTRATION PROGRAMAs a result of the Anti-Car Theft Act of 1992, all statesare required to verify title information prior to registeringvehicles in their own state.

10 The National Motor VehicleTitle Information System (NMVTIS) is the tool used toconduct this verification. When the out-of-state abbreviation presented byNMVTIS does not match that of the SOT (State of Title)listed on the proof of ownership presented by thecustomer, the application must be submitted toPennDOT for the application is processed, the dealer willreceive a "Title Only," and the title and Vehicle recordwill reflect "Sales Tax Unpaid." The dealership may useits dealer registration plates when operating a vehicletitled in this no time should an operator use an exemption 21 toprocess a title application for a dealership when theyare requesting registration plates and using sales taxexemption codes 01 or 0.
