5 Justice RN Leon identified haulage and transport accidents asthe second largest category of accidents in an initiative to solve this problem, a tripartite sub -committee was establishedunder the auspices of the Mining Regulation Advisory Committee (MRAC). Thetask group prepared a report which recommended amongst other items that aguideline for a mandatory COP for trackless mobile machines be drafted. As aconsequence the guideline was issued on 30 November 2000 and came into forceon 31 May 2011, the Mine Health and Safety Council (MHSC) noted that accidentsinvolving trackless mobile machines were still at an unacceptably high level, TheMHSC requested MRAC to review the legislation with the view of incorporatingminimum performance standards.

6 IVIRAC recommended that, in addition to revisingthe Guideline, regulations dealing specifically with trackless mobile machinesshould also be published. This recommendation was agreed to by the MHSC. Thisguideline should therefore be read in conjunction with the trackless mobilemachines STATUS OF GUIDELINES AND COPsIn accordance with Section 9(2) of the MHSA an employer must prepare andimplement a COP on any matter affecting the health or safety of employees andother persons who may be directly affected by activities at the mines if the ChiefInspector of Mines (CIOM) requires it. These COPs must comply with any relevantguideline issued by the Chief Inspector of Mines (section 9(3)).
