Any definitions, terms, or conditions used therein are specific to that there is a conflict between the provided scope of work, terms, and conditions and the final contract, thecontract will mandatory pre-bid meeting will be held on February 11, 2011 at 9:00 at the Executive Center,located in the Jefferson Metropolitan McCalla Park, 7151 Jefferson Metropolitan Pkwy, McCalla, AL of the Proposal shall constitute an offer by you to the Railway that you will perform the work subject to allterms and conditions set forth in your proposal that are not inconsistent with any of the other documents listedabove.

2 Railway is not committed to any course of action as a result of its issuance of this Request for Proposal,and further reserves the right to accept or reject any and all proposals for any reason whatsoever. Acceptance ofa proposal will only be made, and will only be effective if made, by Railway in writing. No employee of Railway hasauthority to modify any terms or conditions except by a writing executed by Railway. No employee has authority todo so proposals and all information contained in the proposals will become the private and confidential property ofRailway.
