1 Northern California Carpenters Regional CouncilCARPENTER HIRING HALL POLICIES & PROCEDURESAs approved by the NCCRC Executive Committee March 19, 2014 These rules are designed to ensure a uniform policy for the implementation of the Hiring Hall provisions of Section 49 (Hiring) of the Carpenters 46 Northern California Counties Master Agreement, as required by the Bylaws of the Regional Council . They are not intended to, nor will they amend or modify the provisions of the collective bargaining agreement. Thus, to the extent there is any conflict or inconsistency with the Master Agreement, the provisions of the Master Agreement will prevail.

2 Any person aggrieved by the operation of this hiring hall has the right to submit a grievance under Section 49 (Hiring), paragraph 15 of the Master Agreement. SIGNING A carpenter OUT-OF-WORK LIST Any individual desiring employment shall sign the out-of-work list at a Local Union, appearing personally and shall indicate their name, telephone number, UBC Member ID number and qualifications by type of work desired. Individuals may choose to sign the list at any one (1) carpenter Local, but only one (1) list at a time. It is permissible to sign one (1) carpenter list, one (1) Drywall/Lathing list and any specialty list(s) (for which an individual is appropriately qualified) at the same time.

3 Any individual signing multiple lists under this provision who is later removed from any one (1) list for failure to accept work (as defined below) will be removed from all lists. Individuals should sign the list where they expect to go to work, and should be dispatched from the Local that has territorial jurisdiction over the jobsite in question. However, for the sake of convenience, workers may be dispatched from the Local where they have signed the out-of-work list to a jobsite in another Local s area, if concurrence is granted by a Field Representative from that Local. Any member maintaining his/her name on the out-of-work list and found to be working at the trade may be in violation of the trade rules and subject to removal from the list and a fine of fifty dollars ($ ).

4 It is each individual s responsibility to check that the correct phone number is shown on the out-of-work list. Only one (1) phone number may be listed at a time. When individuals sign the list, they are certifying that their phone number and qualifications are correct. They must personally answer their telephone and be available for work during job call hours. A pager WILL NOT constitute contact and will be treated as a job turn down. Phone numbers may only be changed in person or in writing. Any person using the hiring hall, not belonging to the United Brotherhood of Carpenters and Joiners of America shall be subject to a uniformly applied user fee of fifteen dollars ($ ) per Roll FOR WORK ON THE carpenter LIST It is each individual s responsibility to decide what type of jobs they are qualified to take (residential, commercial, etc.)

5 The out-of-work list will have a space to indicate which of the different classifications of work they will accept. Once they have made that choice, they will only be called for and able to accept job calls in those categories. FAILURE TO CHOOSE ONE (1) OR MORE SPECIFIC CLASSIFICATIONS WILL AUTOMATICALLY RESULT IN MAKING A PERSON ELIGIBLE FOR ALL CATEGORIES LISTED (except for BATT Cards or other certifications such as Certified Welder or Bridge Builder). Individuals may change their classifications only on Roll Call day or when they re-register on the out-of-work hours will be from 7:00 to 9:00 and 3:00 to 5:00 only. (Saturdays, Sundays, recognized holidays and designated days off excluded.)

6 Dispatches for re-hires (who have worked for the Contractor in the past three (3) years within the 46 Northern California Counties) and requests (where the Contractor is entitled to request individuals by name according to the ratios in the Master Agreement) may be dispatched either in the morning or in the afternoon. Dispatching for apprentice re-rates may be done any time during the day. Dispatching will only be done by Field Representatives or employees designated by the Senior Field dispatcher is authorized to dispatch a person as a re-hire or a request unless the dispatcher has in his or her possession a written request for that person signed by an authorized representative of the employer making the request.

7 Whenever an employer seeks to have an employee dispatched by name, there must be a written record of the request. Faxed requests are acceptable, and such written or faxed requests must be maintained for the same period as all other hiring hall records. Email requests for dispatches will be accepted only if they are sent to the appropriate Local Union Hiring Hall s email address (as provided by the Local Union s dispatcher) and contain both the contact informa-tion for the employer s authorized representative (including name, telephone number and fax number) and the job site information necessary for the dispatch. Prior to processing an email request for dispatch, the Local Union s dispatcher will confirm by telephone with the employer s authorized representative the email request for CALLSAll individuals seeking employment shall be in the Local Union Hiring Hall or at the telephone number listed on the out-of-work list during the regularly established daily job call hours.

8 Orders by a Contractor will be announced each morning at 7:00 and dispatching for those calls will take place in the morning only. In the event that additional job calls come in after 7:00 , these orders will be filled by starting over at the top of the out-of-work list. When making a job call, the dispatcher will call the first name on the list with proper qualifications and let the phone ring six (6) times. If the dispatcher receives no answer when attempting to reach an indi-vidual, the dispatcher will wait one (1) minute and call again and if there is still no answer, it will be counted as a job turn down and the next person on the list will be offered the job.

9 The same procedure will apply if the dispatcher receives a busy signal, answering machine or anything other than a successful attempt to reach the individual. The second job turn down in a dispatch week will result in the individual s name being removed from the out-of-work list. Only one (1) turn down will be counted per day. In the event a person is removed from the list for two (2) turn downs without being so notified, the Local will send a written notice to the last known address of that individual. When ALL journeymen or ALL apprentices on the list have been offered the job in their area and it is still available, it then will be offered to the nearest adjacent area.

10 Once begun, job orders will be worked on until completed, which may include making job calls to members after 9:00 This includes job orders made in advance and job orders received during the hours of 7:00 and 9:00 Any job call made after 9:00 will not be counted as a TO ACCEPT WORK In keeping with the terms of the Contract, if an individual refuses to accept work for which they had previously self-qualified twice in one (1) week, their name will be removed from the out-of-work list and any other out-of-work lists they may be on. They may immediately re-sign the list(s) if they are so removed, but only at the bottom of the list, not their former place.
