1 NSW Trustee & Guardian and the Public Guardian Helping in different waysThe Public Guardian The Public Guardian is appointed by a court or tribunal, to make health and lifestyle decisions for people who are unable to make decisions. This is sometimes because of a disability such as dementia, intellectual disability, brain injury or mental illness. The Public Guardian is the Guardian of last resort and appointed because the person may be unable to make an informed decision themselves. When acting as someone s Guardian , the Public Guardian makes decisions on behalf of the person about things like accommodation, medical and dental needs, health care and other services. The Public Guardian will work with NSW Trustee & Guardian when financial decisions are required for a shared Public Guardian provides support and information to private guardians appointed by a court or tribunal and enduring guardians appointed by the person before they lose capacity. Assistance is given through the Private Guardian Support Unit, which provides telephone advice and publications to assist guardians in their work.
