4 S. ECONOMIC AND TRADE SANCTIONS CLAUSEIt is hereby understood and agreed, whenever coverage provided by this POLICY would bein violation of any U. S. economic or trade sanctions such as, but not limited to, thosesanctions administered and enforced by the U. S. Treasury Department s Office ofForeign Assets Control ( OFAC ), such coverage shall be null and , any coverage relating to or referred to in any certificates or other evidences ofinsurance or any claim that would be in violation of U. S. economic or trade sanctions asdescribed above shall also be null and EXCESS LOSS COMMITTEE INFORMATION TECHNOLOGY HAZARDSCLAUSEL osses otherwise recoverable under this POLICY arising, directly or indirectly, out of, or damage to, reduction or alteration in the functionality or operation ofa computer system, hardware, program, software, data, information repository,microchip, integrated circuit or similar device in orconnected with computer equipmentor non-computer equipment, whether the property of the insured or not,shall not be such losses are caused directly by one or more of the following physical perils, namelytheft of equipment, collision, sinking, grounding or stranding of carrying vessel,overturning or derailment of land conveyance, jettison or washing overboard, fire,lightning, explosion, aircraft or vehicle impact, falling objects, windstorm, hail.

7 Or(b)resulting from the hazardous properties of nuclear material and withrespect to which (1) any person or organization is required to maintainfinancial protection pursuant to the Atomic Energy Act of 1954, or any lawamendatory thereof, or (2) the insured is, or had this POLICY not beenissued would be, entitled to indemnity from the United States of America,orany agency thereof, under any agreement entered into by the UnitedStates of America, or anyagency thereof, with any person any Medical Payments Coverage, or under any SupplementaryPayments Provision relating to immediate medical or surgical relief, toexpenses incurred with respect to bodily injury, sickness, disease or deathSAMPLEPage5 of6 MUA 1000 0210resulting from the hazardous properties of nuclear material and arising out ofthe operation of a nuclear facility by any person or any Liability Coverage, to injury, sickness, disease, death ordestruction resulting from the hazardous properties of nuclear material, if.

8 (a)the nuclear material (1) is at any nuclear facility owned by, or operated byor on behalf of, an insured or (2) has been discharged or dispersedtherefrom;(b)the nuclear material is contained in spent fuel or waste at any timepossessed, handled, used, processed, stored, transported or disposed ofby or on behalf of an insured; or(c)the injury, sickness, disease, death or destruction arises out of thefurnishing by an insured of services, materials, parts or equipment inconnection with the planning, construction, maintenance, operation or useof any nuclear facility, but if such facility is located within the UnitedStates of America, its territories or possessions or Canada, this exclusion (c) applies only to injury to or destruction of property at such used in this endorsement:"hazardous properties" include radioactive, toxic or explosive properties;"nuclear material" means source material, special nuclear material or by-product material; "sourcematerial", "special nuclear material", and "by-product material" have the meanings given them in the Atomic Energy Act1954 or in any lawamendatory thereof; "spent fuel" means any fuel elementor fuel component, solid or liquid, which has been used or exposed toradiation in a nuclear reactor; "waste" means any waste material (1)containing by-product material and (2) resulting from the operation by anyperson or organization of any nuclear facility included within the definition ofnuclear facility under paragraph (a) or (b) thereof.

9 "nuclear facility" means:(a)any nuclear reactor,(b)any equipment or device designed or used for (1) separating the isotopesof uranium or plutonium, (2) processing or utilizing spent fuel, or (3)handling, processing or packaging waste,(c)any equipment or device used for the processing, fabricating or alloying ofspecial nuclear material if at any time the total amount of such material inthe custody of the insured at the premises where such equipment ordevice is located consists of or contains more than 25 grams of plutoniumor uranium 233 or any combination thereof, or more than 250 grams ofuranium 235,(d)any structure, basin, excavation, premises or place prepared or used forthe storage or disposal of waste,SAMPLEPage6 of6 MUA 1000 0210and includes the site on which any of the foregoing is located, all operationsconducted on such site and all premises used for such operations.

10 "nuclearreactor" means any apparatus designed or used to sustain nuclear fission ina self-supporting chain reaction or to contain a critical mass of fissionablematerial.
