I OLIVER TOWNSHIP . PERRY COUNTY, PENNSYLVANIA. ORDINANCE NO. 1 AN ORDINANCE REGULATING THE SUBDIVISION OF LAND AND DEVELOPMENT. WITHIN THE TOWNSHIP OF OLIVER , PERRY COUNTY, PENNSYLVANIA, i I PROVIDING TOR THE PREPARATION OF PRELIMINARY AND FINAL PLATS FOR. SUCH PURPOSE; RQUIRING CERTAIN IMPROVEMENTS TO BE MADE OR. GUARANTEED TO BE MADE BY THE SUBDIVIDER: REGULATING SALES OF LOTS, I ERECTIN OF BUILDINGS, LAY OUT, CONSTRUCTION, OPENING AND DEDICATION.
6 OF STREETS, SEWERS, OTHER FACILITIES, AND PUBLIC IMPROVEMENTS IN. CONNECTION WITH SUBDIVISIONS, AND PRESCRIBING PENALTIES FOR THE. I VIOLATION THEREOF. ARTICLE I. I GENERAL PROVISIONS. I Section 101 - Title A. These regulations shall be know and may be cited as The OLIVER Townshp Subdivision I And Land Development Ordinance . I Section 102 - Purpose I A. This Ordinance has been adopted by the OLIVER TOWNSHIP board of Supervisors to protect the health, safety, morals and general welfare of the citizens of the TOWNSHIP ; to provide for the harmonious development of the TOWNSHIP by insuring equitablehandling of all 1 subdivision or land development plans by providing uniform standards and procedures; by guiding the development and growth of structures; types and locations of streets, open spaces and public ground, recreation, proper traffic flows, light and air, and the proper I distribution of population to insure conditions favorable to the health, safety, morals and general welfare of the citizens of OLIVER TOWNSHIP .
7 I Section 103 - Authority I A. The OLIVER TOWNSHIP planning Commission is hereby designated by the OLIVER TOWNSHIP board of Supervisors as the agency, which shall review and make recommendations on all Preliminary and Final Plats as required herein. The OLIVER TOWNSHIP board of Supervisors I shall have authority to approve all Preliminary and Final Plats as required herein for the TOWNSHIP of OLIVER . I. 8 I- 1. I. I Section 104 - County Review I A. Applications for review of subdivision and land development within OLIVER TOWNSHIP must be forwarded upon receipt by the OLIVER TOWNSHIP Secretary to the Perry County planning Commission for review and report and the municipality shall not approve such 1 applications until the county report is received, or until the expiration of thirty (30) days from the date application was forwarded to the county.
8 I Section 105 - Application of Regulations I A. No subdivision or land development of any lot, tract or parcel of land in OLIVER Townshp shall be effected; no street, sanitary sewer, storm sewer, water main, or other facilities in connection therewith shall be laid out, constructed, opened or dedicated for public use or 8 travel, or for the common use of occupants of buildings thereon unless and until a final subdivision or land development plat has been approved by the board of Supervisors and publicly recorded in the manner prescribed herein; not otherwise, except in strkt I accordance with the provisions of this Ordinance. B. No lot in a subdivision may be sold; no permit to erect or alter any building or structure in I a subdivision or land development may be issued; and no building may be erected in a subdivision or land development, until a final subdivision plat has been approved by the I OLIVER TOWNSHIP board of Supervisors and recorded, and until construction of the improvements required in connection therewith has been guaranteed in the manner prescribed herein.
9 I Section 106 - Interpretation I A. In interpreting and applying the provisions of this Ordinance, they shall be held to be minimum requirements for the promotion of public health, safety, comfort, convenience I and general welfare. Where provisions of a statute, other ordinance, resolution or regulation imposes greater restrictions than this Ordinance, the provisions of such statute, resolution, ordinance or regulation shall be controlling. I Section 107 - Effective Date I A. This Ordinance shall become effective in accordance with applicable law and may be amended from time to time in accordance with procedure established by law. 1. I. I. I 1-2. B. I ARTICLE I1. 1 DEFINITIONS. I Section 201 - General A. Unless otherwise expressly stated, the following shall, for the purpose of these I regulations have the meaning indicated: 1.

The words person subdivider developer and owner include a 'I, 'I, corporation, unincorporated association and partnership, or other legal entity, as well as an individual engaged in the subdivision of land 1 and/or land development. 4. The word building includes structure and shall be construed as if followed 1 by the phrase orpart thereof '. I 5. The word watercourse includes channels, creek, ditch, dry run, spring stream and river. I 6. The words should and may are permissive, the words shall and will are mandatory and directive. I Section 202 - Definitions of Terms I ABANDON: To give up or cease the active use or occupancy of a building, structure or land. ACCELERATED EROSION: The removal of surface material by the action of natural elements I caused by man's manipulation of the landscape.
