1 PSC RegulationsPSC RegulationsHome Energy FairPracticesActRules Governing the Provision of Gas, Electricand Steam Service to Residential Customers(incorporating amendments from theEnergy Consumer Protection Act of 2002)New York State Public Service Commission12/08 Since 1981, the New York State Home Energy FairPractices Act (HEFPA) has provided residential energycustomers with comprehensive protections in areas such as application for services , customer billing, and payment and complaint procedures. In 2002, in light ofthe restructured competitive retail Energy market, theNew York State Legislature amended HEFPA to includeenergy service companies (ESCOs) that provide gas and electric service to residential customers.
2 Under the amendments, ESCOs are required to provide theircustomers with protections similar to those afforded to gas and electric utility customers. These new provisionsensure fair treatment of all residential Energy customers,and serve to strengthen consumer protections and consumerconfidence in New York s competitive Energy Public Service Commission has prepared this booklet as a reference guide for consumers, ESCOs andutilities. The booklet contains the Commission s revisedrules implementing HEFPA and the Energy ConsumerProtection Act. If you need additional information orassistance, please refer to the telephone numbers andaddresses in the back of this New York State Public Service CommissionAbout the CommissionThe New York State Public Service Commission (PSC) regulates the state s electric, gas, steam, water and telecommunications Commission also oversees the cable industry.
3 The Commission isbipartisan and consists of up to five members, each appointed by theGovernor and confirmed by the State Senate for a term of six years, or to complete an unexpired term of a former Commissioner. TheChairman, designated by the Governor, also is the chief executive officer of the Department of Public Service. The Department is the staff arm of the StatementThe primary mission of the New York State Department of PublicService is to ensure safe, secure, and reliable access to electric, gas,steam, telecommunications, and water services for New York State s residential and business consumers, at just and reasonablerates.
4 The Department seeks to stimulate innovation, strategic infrastructure investment, consumer awareness, competitive markets where feasible, and the use of resources in an efficient and environmentally sound manner. The Home Energy fair Practices Act and the Energy Consumer Protection ActThe Home Energy fair Practices Act (HEFPA) was enacted in 1981and established as state policy that the continued provision of gas, electric and steam service to residential customers without unreasonablequalifications or lengthy delays is necessary for the preservation of the health and general welfare and is in the public interest.
5 In 2002, the New York State Legislature enacted the Energy ConsumerProtection Act which amended HEFPA to include Energy service companies (ESCOs) and any other entity that provides gas and electricservice to residential customers. 9 1981, ch. 713) and the EnergyConsumer Protection Act of 2002 (L. 2002, ch. 686). Those actsestablish as State policy that the continued provision of all or any partof gas, electric and steam service to all residential customers withoutunreasonable qualifications or lengthy delays is necessary for thepreservation of the health and general welfare and is in the publicinterest. Applicability of rules (a)Notwithstanding any other commission rule or order to the contrary, this Part governs the rights, duties and obligations of every gas corporation, electric corporation, gas and electric corporation, steam corporation and municipality subject to the jurisdiction of the commission by virtue of articles 2, 4 and 4-A of the Public Service Law, their residential customers and applicants for residential service.
10 When used in this Part:(1) (i)The term utilitymeans any such gas corporation, electric corporation, gas and electric corporation, steam corporation, municipality, or any entity that, in any manner, sells or facilitates the sale, furnishing or provision of gas or electric commodity to residential customers; provided, however, that the term does not include any municipality that is exempt from commission regulation by virtue of section 1005(5)(g) of the Public Authorities Law.(ii)The term distribution utilitymeans any utility that is authorized under any general or special law, or any charter or franchise, to lay down, erect or maintain pipes, conduits, ducts, mains, poles or other gas or electricity distributing fixtures, in, on, over, or under streets, highways, or public places; provided, however, that the term does not included any municipality that is exempt from commission regulation by virtue of section1005(5)(g) of the Public Authorities Law.
