CONTENTSI ntroductionThe Safety , Health and Welfare at Work (GeneralApplication) (Amendment) Regulations 2012 ( 445 of 2012) amend the Safety , Health andWelfare at Work ( general Application) Regulations2007 ( No. 299 of 2007) by adding a Part 10and associated Schedule 12 to deal with failure of Pressure equipment can result infatalities and serious injuries and cause majordamage to property.

4 The purpose of theRegulations is to provide a robust regime for themanagement of Pressure Systems , including clearrequirements for periodic statutory examinationsof Pressure vessels. This guide is not intended as a legalinterpretation of the is it adetailed technical document that covers all theimplications of any given Regulation. The Safety , Health and Welfare at Work (GeneralApplication) (Amendment) Regulations 2012,came into operation on 1st January 2013. Therepeal of the Boiler Explosions Acts from 1882 and1890 and provisions of the Safety in Industry Acts1955 and 1980 relating to steam boilers andsteam and air receivers was also activated by theSafety, Health and Welfare at Work Act 2005(Commencement) Order 2012 ( No.)

5 446 of2012) on 1st January this guide the text of the Regulations is shownin general Application (Amendment)Regulations 2012 are made under the Safety , Health and Welfare at Work Act 2005 (No. 10 of2005) which is referred to in this guide as the 2005 Act .These Regulations apply, subject to theexceptions listed in Part A of Schedule 12, topressure Systems and Pressure equipment in anywork location. The objective is to control thehazards presented by Pressure Systems by way ofdesign, installation, maintenance and periodicvessel examination.

6 The definitions of Pressure equipment and Pressure Systems in Regulation 183 cover awide variety of equipment in use at workplaces. 2 Guide to the Safety , Health and Welfare at Work ( general Application)(Amendment) Regulations 2012 Pressure SYSTEMSI ntroductionExamples of Pressure Systems include: steam boilers and steam heating Systems ; pressurised process plant and piping; compressed air Systems (fixed and portable); refrigeration of Pressure equipment include: Pressure cookers, autoclaves and retorts; heat exchangers; valves, steam traps and filters; piping and hoses.

7 Pressure gauges and level Regulations apply to Pressure equipment inuse; they do not cover the duties of those placingpressure equipment on the EU market for the firsttime; these are addressed in the EuropeanCommunities (Simple Pressure Vessels)Regulations 1996 ( No. 33 of 1996) whichimplements Directive 87/404/EEC and theEuropean Communities ( Pressure Equipment)Regulations 1999 ( No. 400 of 1999) whichimplements Directive 97/23/EC and the EuropeanCommunities(Carriage of Dangerous Goods byRoad and Use of Transportable PressureEquipment) Regulations,2011( of 2011)which implements Directive 2010/35/EU.

8 It is important to note that these Regulations areintended to ensure the mechanical integrityrequired by the pressurised state of theequipment. The Regulations are not intended todeal with other hazards that may arise from theoperation of a Pressure system such as theconsequences of a Pressure release involvingtoxic or flammable contents. Such hazards aredealt with under provisions of other legislationsuch as the Safety , Health and Welfare at Work(Chemical Agents) Regulations 2001 ( No. 619of 2001) and the European Communities (Controlof Major Accident Hazards Involving DangerousSubstances) Regulations 2006 ( No.)

9 74 of2006).3 Guide to the Safety , Health and Welfare at Work ( general Application)(Amendment) Regulations 2012 Pressure SYSTEMSR egulation 183: Interpretation for Part 10183. (1) In this Part danger in relation to a Pressure system means reasonably foreseeable danger to persons fromsystem failure; examination means a careful and critical scrutiny of a Pressure system or part of a pressuresystem, in or out of service as appropriate, using suitable techniques, including testing whereappropriate, to assess (a) its actual condition, and(b) whether, for the period up to the next examination, it is safe to operate when properly used if normal maintenance is carried out.

10 Fluid means gases, liquids and vapours in pure phase as well as mixtures thereof and fluid maycontain a suspension of solids; maximum allowable Pressure or "minimum allowable Pressure " means the maximum pressureand minimum Pressure , as the case may be, for which the equipment, or part thereof, is designed,as specified by the manufacturer; maximum allowable temperature or minimum allowable temperature means the maximum orminimum temperature, as the case may be, for which the equipment is designed, as specified bythe manufacturer; pipeline means a pipe or system of pipes used for theconveyance of relevant fluid across the boundaries ofpremises, together with any apparatus for inducing orfacilitating the flow of relevant fluid through, or through apart of, the pipe or system , and any valves, valvechambers, pumps, compressors and similar works whichare annexed to, or incorporated in the course of, the pipeor system .
