ThemembershipoftheMinnesotaChippewaTribe shallconsistofthefollowing:(a) ,1941,preparedpursuanttotheTreatywithsai dIndiansasenactedbyCongressintheActofJan uary14,1889(25 Stat642)andActsamendatorythereof,andasco rrectedbytheTribalExecutiveCommitteeandr atifiedbytheTribalDelegates,whichrollsha llbeknownasthebasicmembershiprolloftheTr ibe.

2 (b)AllchildrenofMinnesotaChippewaIndianb loodbornbetweenApril14,1941,thedateofthe annuityroll,andJuly3,1961,thedateofappro valofthemembershipordinancebytheAreaDire ctor,toa parentorparents,eitherorbothofwhosenames appearonthebasicmembershiproll,provideda napplicationforenrollmentwasfiledwiththe SecretaryoftheTribalDelegatesbyJuly4,196 2,oneyearafterthedateofapprovaloftheordi nancebytheAreaDirector.(c)Allchildrenofa tleastonequarter(1/4)degreeMirmesotaChip pewaIndianbloodbornafterJuly3,1961,toa member, ,1961,shallbeeligibleforenrollmentifenro lledasa memberofanothertribe, ,butwhobecauseofanerrorhasnotbeenenrolle d,maybeadmittedtomembershipintheMinnesot aChippewaTribebyadoption,ifsuchadoptioni s approvedbytheTribalExecutiveCommittee, -GOVERNINGBODYT hegoverningbodiesoftheMinnesotaChippewaT ribeshallbetheTribalExecutiveCommitteean dtheReservationBusinessCommitteesoftheWh iteEarth,LeechLake,FondduLac,BoisForte(N ettLake),andGrandPortageReservations,and theNonremovalMilleLacBandofChippewaIndia ns,hereinafterreferredtoasthesix(6) (6) ,atitsfirstmeeting,selectfromwithinthegr oupa President,a Vice-President,a Secretary,anda Treasurerwhoshallcontinueinofficeforthep eriodoftwo(2) (6)Reservationsshallelecta ReservationBusinessCommitteecomposedofno tmorethanfIve(5)membersnorlessthanthree( 3) Chairman,Secretary-Treasurer,andone(1),t wo(2),orthree(3) (6)

3 Reservationsshallbeheldinaccordancewitha uniformelectionordinancetobeadoptedbythe TribalExecutiveCommitteewhichshallprovid ethat:(a)Allmembersofthetribe,eighteen(1 8)yearsofageorover, (b)Allelectionsshallprovideforabsenteeba llotsandsecretballotvoting.(c)EachReserv ationBusinessCommitteeshallbethesolejudg eofthequalificationsofitsvoters.(d)Thepr ecincts,pollingplaces,electionboards,tim eforopeningandclosingthepolls, , ,eitherasaCommitteemanorOfficer,untilheo rshehasreachedhisorhertwenty-flTSt(21) (a)ThefirstelectionoftheReservationBusin essCommitteeforthesix(6)Reservationsshal lbecalledandheldwithinninety(90)daysafte rthedateonwhichtheseamendmentsbecameeffe ctiveinaccordancewithSectionI,ofthisArti cle.(b)ForthepurposeoftheflTStelection,t heChairmanandone(1) ~ ,thetermofofficeforofficersandcommitteem enshallbefour(4) , ,eitherasa CommitteemanorOfficer,if heorshehaseverbeenconvictedofafelonyofan ykind;orofalessercrimeinvolvingtheft,mis appropriation,orembezzlementofmoney,fund s,assets,orpropertyofanIndiantribeora ,inaccordancewithapplicablelawsorregulat ionsoftheDepartmentoftheInterior,havethe followingpowers:(a)Toemploylegalcounself ortheprotectionandadvancementoftherights oftheMinnesotaChippewaTribe;thechoiceofc ounselandfixingoffeestobesubjecttotheapp rovaloftheSecretaryoftheInterior, , ,approvedbytheSecretaryoftheInterioronJa nuary5, ,approvedbytheSecretaryoftheInterioronNo vember6, ,approvedbytheSecretaryoftheInterioronJa nuary5,2006.

4 (b)Topreventanysale,disposition,leaseore ncumbranceoftriballands,interestinlands, orotherassetsincludingminerals,gasandoil .(c)ToadvisewiththeSecretaryoftheInterio rwithregardtoallappropriationestimatesor FederalprojectsforthebenefitoftheMinneso taChippewaTribe,exceptwheresuchappropria tionestimatesorprojectsareforthebenefito findividualReservations.(d)Toadministera nyfundswithinthecontroloftheTribe;tomake expendituresfromtribalfundsforsalaries,e xpensesoftribalofficials, ,underthecontroloftheTribalExecutiveComm ittee,shallbeinaccordancewithabudget,dul yapprovedbyresolutioninlegalsession,andt heamountssoexpendedshallbea ,requestingadvancementstothecontrolofthe Tribeofanymoneydepositedtothecreditofthe TribeintheUnitedStatesTreasury,subjectto theapprovaloftheSecretaryoftheInterioror hisauthorizedrepresentative.(e)Toconsult ,negotiate,contractandconcludeagreements onbehalfoftheMinnesotaChippewaTribewithF ederal,Stateandlocalgovernmentsorprivate personsororganizationsonallmatterswithin thepowersoftheTribalExecutiveCommittee, (t)Exceptforthosepowershereinaftergrante dtotheReservationBusinessCommittees,theT ribalExecutiveCommitteeshallbeauthorized tomanage,lease,permit,orotherwisedealwit htriballands,interestsinlandsorothertrib alassets;toengageinanybusinessthatwillfu rthertheeconomicwellbeingofmembersoftheT ribe;toborrowmoneyfromtheFederalGovernme ntorothersourcesandtodirecttheuseofsuchf undsforproductive purposes,ortoloanthemoneythusborrowedtoB usinessCommitteesoftheReservationsandtop ledgeorassignchattelorincome,dueortobeco medue,subjectonlytotheapprovaloftheSecre taryoftheInteriororhisauthorizedrepresen tative,whenrequiredbyFederallaworregulat ions.

5 (g)TheTribalExecutiveCommitteemaybyordin ance,subjecttothereviewoftheSecretaryoft heInterior,levylicensesorfeesonnon-membe rsornon-tribalorganizationsdoingbusiness ontwoormoreReservations.(h)Torecognizean ycommunityorganizations,associationsorco mmitteesopentomembersoftheseveralReserva tionsandtoapprovesuchorganizations,subje cttotheprovisionthatnosuchorganizations, associations,orcommitteesmayassumeanyaut horitygrantedtotheTribalExecutiveCommitt eeorto theReservationBusinessCommittees.(i)Tode legatetocommittees,officers,employeesorc ooperativeassociationsanyoftheforegoinga uthorities, Committeesshall,inaccordancewithapplicab lelawsorregulationsoftheDepartmentoftheI nterior,havethefollowingpowers:(a)Toadvi sewiththeSecretaryoftheInteriorwithregar dtoallappropriationestimatesonFederalpro jectsforthebenefitofitsReservation.(b)To administeranyfundswithinthecontroloftheR eservation;tomakeexpendituresfromReserva tionfundsforsalaries,expensesofReservati onofficials, budget,dulyapprovedbyresolutioninlegalse ssion,andtheamountssoexpendedshallbea (c)Toconsult,negotiateandcontractandconc ludeagreementsonbehalfofitsrespectiveRes ervationwithFederal,Stateandlocalgovernm entsorprivatepersonsororganizationsonall matterswithinthepoweroftheReservationBus inessCommittee, ,lease,permitorotherwisedealwithtriballa nds,interestsinlandsorothertribalassets, ;toborrowmoneyfromtheFederalGovernmentor othersourcesandtodirecttheuseofsuchfunds forproductivepurposesortoloanthemoneythu sborrowedtomembersoftheReservationandtop ledgeorassignReservationchattelorincomed ueortobecomedue, ,withtheconsentoftheTribalExecutiveCommi ttee,pledgeorassigntribalchattelorincome .

6 (d)TheReservationBusinessCommitteemaybyo rdinance,subjecttothereviewoftheSecretar yoftheInterior, ,associationorcommitteeopentomembersofth eReservationorlocatedwithintheReservatio nandapprovesuchorganization,subjecttothe provisionthatnosuchorganization,associat ionorcommitteemayassumeanyauthoritygrant edtotheReservationBusinessCommitteeortot heTribalExecutiveCommittee.(e)Todelegate tocommittees,officers,employeesorcoopera tiveassociationsanyoftheforegoingauthori ties,reservingtherighttoreviewanyactiont akenbyvirtueofsuchdelegatedauthorities.( f) theActofJune18,1934( ), ,themajorityofeligiblevotescastshallrule , ,respectively,shallrequireallpersons,cha rgedbytheTribeorReservationwithresponsib ilityforthecustodyofanyofitsfundsorprope rty, responsiblebondingcompanyandshallbeaccep tabletothebeneficiarythereofandtheSecret aryoftheInteriororhisauthorizedrepresent ative, , two-thirds(213)voteofitsmembersshallremo veanyofficerormemberoftheCommitteeforthe followingcauses:(a)Malfeasanceinthehandl ingoftribalaffairs.

8 MembersoftheTribalExecutiveCommittee,sha llsubmitanyenactedorproposedresolutionor ordinanceoftheTribalExecutiveCommitteeto a ,uponreceiptofa petitionsignedby20percentoftheresidentvo tersoftheReservation,orbyanaffirmativevo teofamajorityofthemembersoftheReservatio nBusinessCommittee,shallsubmitanyenacted orproposedresolutionorordinanceoftheRese rvationBusinessCommitteetoa ,whichbythetermsofthisConstitutionandByl awsissubjecttoreviewbytheSecretaryoftheI nterior,orhisauthorizedrepresentative,sh allbepresentedtotheSuperintendentoroffic erinchargeoftheReservationwhoshallwithin ten(10) ,buttheSuperintendentorofficerinchargesh alltransmita copyofthesame,bearinghisendorsement,toth eSecretaryoftheInterior,whomaywithinnine ty(90)daysfromthedateofapproval, (l0) ,it may,bya majorityvote,refertheordinanceorresoluti ontotheSecretaryoftheInterior,whomay,wit hinninety(90)daysfromthedateofitsreferra l,approveorrejectthesameinwriting, ,whichbythetermsofthisConstitutionandByl awsis subjectedtoreviewbytheSecretaryoftheInte riororhisauthorizedrepresentative, ,whichbythetermsofthisConstitutionandByl awsissubjecttoapprovalbytheTribalExecuti veCommittee,shallwithinten(10) , ReservationBusinessCommittee,itshalladvi setheReservationBusinessCommitteewithint en(l0)days, ,atthattime, :(a)Presideatallregularandspecialmeeting softheTribalExecutiveCommitteeandatanyme etingoftheMinnesotaChippewaTribeingenera lcouncil.
