DefinitionsFor the purpose of these RULES and REGULATIONS :(1) AGENT(S) means the person(s) authorized by the owner to act on behalf of theowner.(2) AIR-GAP means a physical break between a supply pipe and a receiving of the air gap shall be approved by the Department.

6 (3) APPLICANT means the person(s) requesting water service.(4) APPROVED BACKFLOW PREVENTION ASSEMBLY means a collection ofcomponents which together as a unit, is approved for use by the Department for the prevention ofbackflow.(5) AUXILIARY WATER SUPPLY means any water supply other than theDepartment s water supply.(6) AWWA means the American Water Works Association.(7) BACKFLOW means a flow condition, caused by a differential in pressure, thatcauses the flow of water or other liquids, gases, mixtures or substances into the distributing pipesof the Department s water supply from any source or sources other than the Department s watersupply source.

7 (8) BOARD means the Water Board of the County of Hawai i as established by theCharter of the County of Hawai i.(9) CAPITAL ASSESSMENT FEE means the special purpose fee, over and beyond thefacilities charge, approved by the Board and to be paid to the Department by the developer,subdivider or consumer as their share to cover the cost of constructing a water system or portionthereof, to provide water service to the development. Fees shall be based upon the additionalnumber of lots, dwelling units or equivalent units in the development or on the property.(10) CERTIFIED GENERAL TESTER means someone who is trained and qualified toperform testing and inspection of all backflow prevention assemblies.

8 The tester s qualificationsshall be approved and recognized by the Department.(11) CONSUMER means any person(s) receiving water service from the Department. (12) CONTAMINANTS means any foreign substances in the water supply which create ahazard to the public health.(13) CONTRACTOR means a person or persons possessing a current and validcontractor s license for the appropriate work as determined by the Department and pursuant toChapter 444, Hawai i Revised Statutes, as amended, and Chapter 8, RULES and REGULATIONS of theContractor License Board, State of Hawai i, as amended.(14) CROSS-CONNECTION means any actual and unprotected connection between theDepartment s water system and any other source or auxiliary water supply.

9 (15) DELINQUENT means an indebtedness to the Department unpaid for 30 days frombilling (16) DEPARTMENT means the Department of Water Supply of the County of Hawai i asdefined by the Hawai i County Charter.(17) DEVELOPER means an owner or other person, agent or legal entity who intends toimprove, or to construct any improvements on real property. The term shall also mean asubdivider.(18) DEVELOPMENT means any improvement on a parcel of real property. The termshall include but not be limited to subdivisions, cluster developments, condominiums,commercial, and resort projects which may be further defined under the Zoning Code of theCounty of Hawai i.

10 (19) DEVELOPMENT WATER SYSTEM means the water system to and/or within anydevelopment, including but not limited to water source and treatment facilities, mains, valves,hydrants, laterals, pumps, tanks, reservoirs and all appurtenances necessary to provide waterservices and fire protection for such development.(20) DOUBLE CHECK VALVE ASSEMBLY means an assembly incorporating twointernally loaded, independently operating check valves, including resilient seated shut-offvalves on each end of the assembly and test cocks for testing the water tightness of each checkvalve.(21) DWELLING UNIT means one or more rooms designed for or containing or used asthe complete facilities for the cooking, sleeping and living area of a single family only andoccupied by no more than one family.
