Accordingly, the company engagedleading safety and compliance consultant LaidlerAssociates, part of the machinery division of T V S DProduct Service , to help with completing the complianceprocedure including the preparation of the technical a well established manufacturer of wind turbines,Proven Energy was well aware that it could satisfy the CEmarking requirements in relation to its products by self-declaring them for compliance with the EMC, Low Voltageand machinery Directives.

9 The company decided, however,that due to the changes to the requirements with the newMachinery Directive, it would be prudent to haveassistance which would give both them and their end usersthe highest possible level of Product that was of most immediate concern to thecompany was its new P35-2 turbine, which has a ratedpower of kW and a reference annual energy (RAE)output in excess of 23,000 kWh. These characteristics,combined with its compact construction and economicalpricing, make it an ideal choice for use by agriculturallandowners, in commercial premises, and in small-scalewind farms. Its market potential was, therefore, excellent and was stillfurther boosted when the P35-2 became the first small windturbine to be awarded full certification under theMicrogeneration Certification Scheme (MCS).Understandably, Proven Energy was eager to put the P35-2on sale at the earliest possible the beginning of 2010, it had the compliance workassociated with the Low Voltage and EMC Directives inplace but, for the machinery Directive, things were a littlemore complicated.

10 This was because a new version(2006/42/EC) of the machinery Directive came into force latein December 2009. As no transition period between this andthe previous version of the machinery Directive wasallowed, it was essential for Proven Energy to be sure thatits P35-2 wind turbine complied fully with the new Product testing for the P35-2 had been completed,Proven Energy knew that the new version of the MachineryDirective introduced significant changes, not least in thearea of documentation. To avoid delay in bringing itsCase Studiesproduct to market, it decided to engage the services of anexpert to verify compliance. The company s choice wasLaidler Associates, which it selected on the basis of proventrack record and excellent reputation in handling projectsof this Associates undertook a comprehensive review ofthe materials relating to the compliance of the P35-2 windturbine with the machinery Directive and did indeed identifya number of shortcomings.
